Fort Septr. 25th 1812 Ex.d This Indenture of three parts made this 6th day of October in the year of our lord one thousand eight hundred and one Between Lemuel Hicks of the county of Isle of wight of the first part Rebecca Turner of the county of So.ampton of the second part and William Urquhart of the sd. county of the third part whereas a marriage is intended to be solemnized between the said Lemuel Hicks and the said Rebecca and it is agreed between the said two last mentioned parties that if the said marriage shall take effect that he the said Lemuel Hicks shall have possess and enjoy the use labour & profits of the slave Jeffry and all other the property of the said Rebecca as is mentioned specifically in a schedule which is hereto annexed so as not to deprive the sd. Rebecca of her equal benefit of the labour of the said Slave Jeffry and the use of the other property in the said schedule mentioned in the lifetime of the said Lemuel and she the said Rebecca shall have power by her last will and testament or otherwise to give devise or dispose of the reversions of the slave aforesaid and the other property mentioned in the said schedule in such manner as the said Rebecca shall think proper now this Indenture there fore witnesseth that as well for the making the said agree =ment good and effectual and of the said intended marriage as also for and in consideration of the sum of one dollar by the said William Urquhart to the said Lemuel Hicks in hand Paid the receipt whereof is hereby acknowledged he the sd. Lemuel Hicks doth hereby for himself his heirs executors and administrators covenant and agree to and with the said William Urquhart his heirs executors and Adm'rs. that notwithstanding the said intended marriage shall take effect that the said Rebecca shall and may at any tme hereafter either by her last will and testament or otherwise give devise or dispose of the slave Jeffry and the other Property in the Schedule herein before mentioned to any Person or Persons or for any use intent or purpose whatsoever and that he the said Lemuel Hicks shall and will permit and Suffer such instrument to be duly [page break] [p.] 589 Proved and all other legal and necessry measures therein to be ta =ken provided nevertheless and it is the true intent and meaning of these presents that such devise bequest or other conveyance shall not take effect till after the decease of the said Lemuel but that the said Lemuel shall and may have hold use and enjoy the slave Jeffry and the said Property as is mentioned in the schedule aforesaid for and during the time of his natural life any thing herein before contained to the contrary notwithstanding and that the said Lemuel his heirs executors and administrators shall not nor will at any time or times hereafter do commit or Suffer or cause to be done committed or suffer any act or thing whatsoever whereby the said Rebecca shall or may be frustrated or hindred from the making or executing such last will & testament or other conveyance for the giving devising or conveying the reversion of the aforesaid slave and other property as aforesaid discribed ac =cording to the true intent and meaning of these Presents _ In Witness whereof the Parties to these presents have hereunto set their hands and seals the day and year first above Written ____ Sealed ackld. and } Delivered in presents of } Lemuel Hicks ĪSealĪ James Clayton } Rebecca Turner ĪSealĪ George Branch William Urquhart ĪSealĪ John Urquhart Joseph Britt jr.
