JOHNSTON & wife Mary to Nathaniel FITZ, deed of bargain & sale, Lot 17, Jerusalem, 2 Aug 1804 (20 Aug 1804) [margin notes] Johnston & wife to Fitz This Indenture made this 2nd. day of August in the year of our lord Christ 1804 Between Benjamin W. Johnston and Mary his wife of the County of Southampton of the one part and Nathaniel Fitz of County Aforesaid of the other part Witnesseth, That the said Benjamin W. Johnston and Mary his wife hath for the Sum of four hundred and fifty dollars to them in hand pd. the receipt they doth hereby Acknowledge, Hath granted Bargained and Sold unto the said Nathaniel Fitz his heirs and Assigns, one Certain lot & building in the town of Jerusalem, which the said Benjamin W. Johnston purchased of Edwin Gray, reference being had to the said Deed and boundaries more fully Appear, To have and to hold the lot and building unto him the said Nathaniel Fitz his heirs and Assigns forever against the Claim of him the said Benjamin W. Johnston and Mary his wife their heirs ex'rs. adm'rs. or assigns and against the Claim of any other person or persons Whatsoever will by these Presents forever Warrant and Defend In Witness whereof we the have hereunto Set our hands & Seals the & year first above Written [page break] [p.] 319 Signed, Sealed, and delivered } Benjamin W. Leonard So.ampton County (to wit) The Commonwealth of Virginia to James Millar and Samuel Blunt Gentlemen Justices of the peace Whereas Benjamin W. Johnston and Mary his wife have by their certain Indenture of bargain and Sale dated the 2nd. day of August 1804 Conveyed unto Nathaniel Fitz of the County of So.ampton the fee Sim -ple estate of and in a Certain tract or parcel of land Situate lying and being in the County of So.ampton Containing by Estimation One half acre of land be the same more or less, and where as the said Mary Cannot Conveniently Come into the Court of our said County to Acknowledge the same Therefore we do give to you power to receive the Acknowledgement which the said Mary Shall be willing to make before you of the Conveyance aforesaid Contained in the said Indenture which is here to annexed and we do there fore command you to go personally to the said Mary and receive Acknowledgement of the same and examine her privately and apart from her husband Whether She hath executed the said deed freely and Voluntarily without the Purs -uasion or threats of her said husband; and Whether she is willing the said Indenture Should be recorded in the County Court of So.ampton, And when you have examined her as aforesaid and taken her Acknowledgement of the said Indenture that you distinctly and openly Certify us here of under your hands and Seals, returning to us also this writ with the said Indenture Annexed Witness Sam.l Kello Clerk of our said Court at his office the 31st. day of July 1804 and in the 29th. year of the Commonwealth ___ Sam.l Kello Cl ~-¤-~ By Virtue of the Annexed Commission to us directed we the Subscribers have Personally waited on Mrs. Mary Johnston wife of Benjamin W. Johnston and exd. her privately and Apart from her said husband who Hath Acknowledged his hand and Seal to the Annexed deed to be her Act and Deed and that She executed the Same freely and Voluntarily without the threats or pursuasion of her said husband, and that She is willing the Same Should be recorded in the County Court of So.ampton, all which we Certify here with enclosed under our hands and Seals this 2nd. day of August 1804 James Millar ¤Seal¤ Saml.
