Goodwyn, James Wilkinson and John Taylor Gentlemen Trustees = as herein after mentioned of the one part, and Samuel Calvert of of the County of So.ampton of the other part Witnesseth, that whereas an act of the General Assembly of Virginia, passed December 7th. 1791 entitled an act to establish Certain towns and other purposes hath enacted that ten Acres of land adjoining the Court house in the County of So.ampton, The property of Joseph and William Scott should be and was thereby Vested in Edwin Gray James Wilkin =son, Samuel Kello, Benjamin Blunt, Thomas Ridley, Benjamin Ruffin Robert Goodwyn and John Taylor Gentlemen ["trustees" overwritten] Justices be by them or a majority of them, Laid of into Lotts, of an half Acre each, with Convenient streets and establish a town by the name of Jerusalem, and whereas the said Act hath fully directed the said Trustees or a majority of them Should proceed to Sell the said Lott at public Auction for the best price that Could be had for the same and Hath empowered the said Trustees to Convey the same to the purchasers thereof in fee _ upon Certain Conditions which may more particularly Known by a reference to the said Act = Now This Indenture Witnesseth that the said Edwin Gray, Thomas Ridley, Robert Goodwyn James Wilkinson and John Taylor Gentlemen Trustees as aforesaid, for, and in Consideration of the sum of twenty Seven pounds Current money of Virginia, paid to the sd. Joseph and William Scott pursuant to the Aforesaid Act = have bargained sold Aliened and Confirmed, and by these presents do, bargain, Sell, alien and Confirm unto the said Saml. Calvert, to him and his heirs forever = To [sic; Two] Lotts or parcels of Land lying in the said town of Jerusalem, distinguished by the plan of the sd. town by Numbers 5 & 6 and bounded as follows (to wit) No. 5. Begining at the No. Corner of No. 4 on the West side of the main Street, thence along the main street 90 feet 4 Inches to the cross street, thence along the cross street 237 feet 9 Inches to the Corner of No. 6, thence on the lines of No. 6 90 feet 4 Inches to the Corner of No. 4, 231 feet 9 Inches to the begining, the other Lott No. 6. begining at the S.W. Corner of No. 5 on the north side of the Cross street thence along the said Street 132 feet to the river thence up the river to the ["said" struck] S.W. Corner of No. 3 thence along the line [page break] [p.] 522 thence along the line of No. 3, 23 feet to the N.W. Corner of No. 4 and thence along the lines of No. 4 and 5 = 18 feet _ 8 Inches to the begining = Together with all the profits, priviledges, and appurtenances Whatsoever to the said premises belonging or in any wise appurtaining, To have and to hold the said two Lotts and appurtenances aforesaid to the said Samuel Calvert to him and his heirs forever = And the Said Samuel Calvert, for him self and his heirs do hereby Covenant and agree with the said Trustees in manner and form following (Vizt.) that he the said Saml. Calvert or his heirs Shall and will build on the said Lott No. 6 the said Lott No. 5 being allready built thereon and improved as the said Act of Assembly directs) and a Dwelling house at Least Sixteen feet square, with a brick or stone Chimney fit for habitation in the Course of ten Years from the Seventh day of December 1801, being a further and the time allowed by an Act of the General Assembly for the building and improving Lotts in the said town of Jerusalem. and the said Trustees do Covenant. and agree to, and with the said Saml. Calvert and his heirs that upon the said Samuel Calvert. and his heirs Well and truly performing and fulfilling all and every of the Covenants and agreements herein Contained According to the true Intent and meaning of these presents they may peacably and Quietly have hold, possess and enjoy the above mentioned premises, with every of the Appurtenances without the let, trouble, hindrance or Molestation of them the said Trustees or any other person or persons Claiming by or under them in fee; Provided Nevertheless, in case the said Saml. Calvert his heirs executors or administrators, unto the said Josiah Vïck his heirs executors or administrators, on or before the first Day of March next ensuing the Date hereof, persuant and in Conformity of the Covenant and agreement On the part of the said Josiah Vick herein after mentioned (to wit) that he the said Josiah Vick for himself and his heirs, hath bargained and Sold and by these presents doth hereby bargain and Sell unto the said Saml. Calvert and his heirs, all the estate Right title Interest Claim and Demand of him the said Josiah Vick & his heirs, of in, and to two Certain Lotts or one half Acre each of Ground, situate in the said twown of Jerusalem and distinguished by the plan of the said Town, by the Numbers five and Six (thus No. 5 No. 6) and in order that the said Saml. Calvert and his heirs may Obtain and Get a Legal right, and title thereto, the said Josiah Vick for him self and his heirs doth hereby agree that the Commissioners of the Said town of Jerusalem or a majority of them_ Shall and may at any time at the will and pleasure of the said Saml. Calvert or his heirs, make and execute unto the said Saml. Calvert or his heirs heirs a Deed or Deeds of Conveyance in fee Subject to the said Saml. Calvert or his heirs Complying with the Conditions of improving the said Lot No. 6 agreeable to the Original Sale of the sd. Lotts of the said Town (the said Lott No. 5 having been duly improved by the said Josiah Vick) which said Conveyance by the said Commissioners aforesaid shall forever be binding against the said Josiah Vick or his heirs or any [page break] [p.] 524 or any other person or persons Claiming by or under him or them or either of them. ___ And the said Sam Calvert in Consideration of the Covenants and agreements herein before mentioned on the part of the said Josiah Vick, doth hereby for himself and his heirs executors and administrators Covenant and agree to and with the said Josiah Vick and his heirs executors and administrators that he the said Sam Calvert his heirs executors or administrators Shall and will on or before the said first Day of March next, (at Which time the said Saml. Calvert or his heirs, is to have full power and authority to receive and take Quiet and Peacably possession of the said Two Lotts of ground and every of their Appurtenances. pay or Cause to be paid unto the said Josiah Vick his heirs executors administrators or assigns the aforesaid Sum of thirteen hundred and fifty like Dollars, for and in full Consideration of the absolute pur =chase of the Said two Lotts of Ground and their Appurtenances and that he the sd. Microfilm Reel 5 CALVERT's executor Henry BRIGGS sold Lot 6 to James TREZVANT, 20 Jan 1815. (Southampton Co., VA, Deed Book 14, pp. 155-57) James TREZVANT & wife Mary B. sold Lot 6 to Thomas E. COSBY, 21 Apr 1817 (19 May 1817). (Southampton Co., VA, Deed Book 15, pp. 244-45) Thomas' widow Elizabeth COSBY brought a chancery suit (1829-022) against his executor, James ROCHELLE. Charles L. WINGFIELD, Marshall of the Superior Court of Chancery for the Williamsburg district, sold Lot 6 - subject to her dower claim - to her, 19 May 1829 (15 Jun 1829), in pursuance of a decree" in a cause therein depending between Thomas Wallace" & other plaintiffs against Elizabeth COSBY, children Thomas, Nancy & Gabriel, and James ROCHELLE. (Southampton Co. DB21:128-29) BRIGGS sold Lot 5 to Joseph GRAY, 16 Jan 1815 (20 Feb 1815). (Southampton Co., VA, Deed Book 14, pp. 167-69) James ROCHELLE sold Lots 5 & 6 to David VALLANCE, 1 Jan 1817 (17 Mar 1817). (Southampton Co., VA, Deed Book 15, pp. 200-01) David VALLANCE of NYC sold Lot 5 to Robert GRAY, 20 Dec 1825 (19 Mar 1827). (Southampton Co., VA, Deed Book 20, pp. 155-56) Thomas GRAY sold Lot 5 & another tract to his son Thomas R. GRAY, 15 Mar 1828. (Southampton Co., VA, Deed Book 20, p. 344) Lot 4 was also purchased from the Jerusalem trustees by Josiah VICK, & then sold to Samuel CALVERT (d. 1813), but no deed was executed for either conveyance. The current trustees executed a deed to CALVERT's administrator Henry BRIGGS [Jr.], 8 Nov 1816 (18 Nov 1816). BRIGGS conveyed Lot 4 to James TREZVANT, undated deed ack. 27 Dec 1816 (Jan 1817).
