All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Southampton County Virginia USGenWeb Archives Land Records Joseph BRITT & wife Rebecca (Rebeckah) to Timothy TYNES, deed of bargain & sale, 12½ acres, 11 Feb 1808 (15 Feb 1808) [margin note] Britt & wife To Tynes This Indenture made this eleventh day of February One thousand eight Hundred & Eight Between Joseph Britt and Rebeckah his wife of So.ton: County of the one part & Timothy Tynes of the aforesaid County of the other part Witnesseth that the Said Joseph Britt and Rebekah his wife for and in consideration of the Sum of twenty four pounds Current money of Virgini =a to them in hand paid by the Said Timothy Tynes at or before the Seal =ing and delivering of these presence the receipt whereof the Said Joseph Britt and wife doth hereby [acknowledge] and themselves to be fully Satisfied & paid and hereof doth clearly acquit and discharge the Said Timothy Tynes his heirs Ex'ors and adm'rs forever by these presence hath given granted bargain =ed Sold enfeoffed and Confirmed by thes presence doth give grant barg =ain Sell enfeoff and confirm unto the Said Timothy Tynes his heirs and assigns forever One Certain tract or prcel of Land Containing by Estimation twelve and half acres be the Same more or less lying and being in the County of Southampton and bounded as followeth, Beginning at a pine a corner tree of John Crumpler Junr. and Joseph Britts line from thence along the main road to a red oak a Corner tree of Joseph Britts & William [page break] [p.] 408 Bowden's line from thence a line of marked trees to a dogwood a Corner tree of West Tines and William Bowdens line from thence a line of marked trees to a black Jack a corner tree of John Crumplers Junr. & David Tynes from thence a line of marked trees to the first Station With all houses Orchards Gardens fences Woods underwoods Waters water courses and with all profits Commodities advantages Emoluments & appurtenances whatsoever part or parcel thereof To Have and to hold the Sd. tract or parcel of land with all and Singular the appurtinances unto the Sd. Timothy Tynes his heirs and assigns forever to the only use and behoof of him the Said Timothy Tynes his heirs and assigns forever And the Said Joseph Britt and Rebeckah his Wife for themselves and their heirs the Sd. granted land with all its premises and their and Every of their appertinances unto the Said Timothy Tynes his heirs and assigns Shall and [will] warrant and forever defend by these presence against any person or persons whatsoever having or lawfully Claiming Right title Property or Interest in or to the same or any part or parcel thereof And the Said Joseph Britt and Rebecah his wife for themselves and their heirs doth grant concent and agree to and with Timothy Tynes his heirs and assigns in manner & form following (Vizt.) The Said Joseph Britt and RebeKah his wife at the time of the Sealing and delivery of these presents is and Stands Seized of and indefeasible Estate in fee Simple of and in to the premises & they have good right and lawful authority to Sell and convey the Same in manner and form aforesaid and that the Same Shall forever remain to the Sd. Timothy Tynes his heirs and assigns freely & Clearly exonerated and discharged of and from all and all manner of bargains Sales and title of Dowry and all other rights & Estates whatsoever - In Witness whereof the Said Joseph Britt & wife that [sic] hereunto Set their hands andaffixed their Seals the day and year above written Signed Sealed and acknowledged { Joseph Britt ¤Seal¤ in the presence of { her John Crumpler Junr. { Rebecca x Britt ¤Seal¤ Samuel Crumpler { mark his { Beazant + Britt { mark The commonwealth of Virginia to Simon Boykin & Solomon Holmes Gentlemen Justices of the Peace Whereas Joseph Britt and Rebecca his wife have by their Certain Indenture of bargain and Sale dated the 11th day of February 1808 Conveyed unto Timothy Tynes of the Said County of Southampton the fee Simple estate of and in 12½ acres of land lying and being in the County aforesaid [page break] [p.] 408 [sic] and whereas the Said Rebecca cannot Conveniently traver to the court of our Said County to acknowledge the Same therefore we do give to you power to receive the acknowledgement which the Said Rebecca Shall be willing to make before you of the conveyance aforesaid contained in the Sd. Indentu =re which is hereto hereto annexed and we do command you to go perso =nally to the Said Rebecca and examine her privately and apart from her husband whether She hath executed Executed the Said deed freely and voluntarily without the pursuasion or threats of her husband, and when you have examined her as aforesaid and received her acknowledgement of the Said Indenture that you distincly and openly Certify us [t]hereof, under your ha =nd and Seals returning to us also this writ with the Said Indenture annexed Witness Saml. Southampton County (Sct) In obedience to a commission to us Directed bearing date 21st Decr. 1807 - we have personally gone to Rebecca Britt wife of Joseph Britt and examined her privily and apart from her husband whether She hath freely and Voluntarily without the persuasion or threats of her husband executed the annexed Ind =enture and whether She be willing the Same Should be recorded and do Certify that She acknowledgeth the Same was executed by her without the persuasion or threats of her hunsband; & that She is willing the Same Shoud be recorded ~ Given under our hands and Seals this eleventh day of February 1808. Britt chose Solomon Holmes who gave bond & abs Hy. Blow prest. Jno. Lee = Jno. Urquhart app'g guardian to Ann & Mary Bailey orphans of Hartwell Bailey who gave bond & Secy. = Ordered that Philip Raiford, Wm. Crumpler, Robert Mercer Benjamin Willson or any 3 appraise Jas.
