Urquhart May 16:1809 -S.Kello This Indenture made this Sixteenth day of January in the year of our Lord one thousand eight hundred and eight. Between Arthur Holleman and John Harris, Commissioners appointed by a decree of the worshipful Court of Southam =pton bearing date November 1807. of the one part and Moses Johnson of the county aforesaid of the other part __ Witnesseth that Arthur Holleman and John Harris hath for and in Consideration of the Sum of Eight hundred Dollars current money of Virginia to them paid by the said Moses Johnson, the receipt where =of they the said Arthur Holleman and John Harris do hereby acknowledge and confess, they the said Arthur Holleman and John Harris have Granted Bargained and Sold and by these presents do grant bargain and Sell alien enfeoff and confirm unto the said Moses Johnson, his heirs and Assigns one certain Tract of Land Situate, lying and being in the county of South =ampton and bounded as follows _ Beginning at a turkey oak in Lucy Williamsons line thence along a line of marked trees South thirty five degrees East one hundred and forty four pole to a pine thence South Sixty two degrees East twenty pole to a Spanish oak in Matthew Britts Line thence along the Said Britts line, North eighty eight Degrees east . Seventeen pole to a pine, thence along the Said line South eighty three degrees east two hundred and twenty three pole to a pine thence along a line of marked trees north Six degrees east thirty four pole to a pine in John Claytons line thence along the Said Claytons line, North forty Seven degrees west fifty eight pole to a turkey oak thence north eighty two Degrees west one hundred & forty eight pole to a pine thence a Straight course of marked Trees, north Fifty eight degrees East one hund =red & Sixty pole to the Beginning, with all houses orchards waters & water Courses, profits and Hereditaments whatsoever to the Said Tract of Land and premises belonging or in any wise appurtaining thereto in or upon the Same; also the reversion and reversions, remainder and remain =ders, rents and Services of all and Singular the Said premises with their appertinances &c. To have and to hold the Said tract of land & appurtinances unto the Said Moses Johnson his heirs and assigns to the only proper use of him his heirs & assigns [page break] [p.] 415 forever. BAILEY was granted administration on Benjamin's estate (OB1804-06:247, 249). At his death, Benjamin owned a 200-acre tract. His daughters & their husbands - including Moses & Polly (BRITT) JOHNSON - instituted a "friendly suit in Chancery" against Benjamin's widow Ann BRITT, to have her dower (1/3) laid off and the remainder sold. The court decreed that should be done, and appointed the commissioners to execute the same. The suit, styled LAWRENCE et ux. et. al. v. BRITT, is posted at: http://files.usgwarchives.net/va/southampton/court/1808_007.txt Moses JOHNSON secured his bonds to the Commissioners by executing a deed of trust on this tract- acreage specified (unlike this deed)- as well as personal property, to William BAILEY, for the benefit of William LAWRENCE and Timothy TYNES, Moses' securities.
