Fort Examined & Delivered To J. Fort May 1810 This Indenture made this 27th. day of August in the year of our lord one thousand eight hundred and eight Between, Henry Blow, Wm. Blow Thomas D. Price, Alex. Mc.Neel and Samuel Blunt Gentlemen ___ Trustees for the town of Jerusalem of the one part and Joshua Fort of the other part__ Witnesseth that the said trustees doth bargain sell, alien and Confirm, unto the Said J. Fort, and his heirs forever, one certain Lot or parcel of land lying in the said Town of Jerusalem Number Nine Containing one half acres; and bounded as follows Viz.. Beginning at the No. West Corner of J. Forts lot No. 7 on the South side of the Cross Street, binding on the sd. South Side of the Sd. Cross Street, one hundred and two feet three inches, to the North East Corner of Lot No. 10, thence along the east Side of No. 10, one hundred and eighty feet eight inches to a narrow Slipe of land purchased by the said J. Fort, of Josiah Vick, thence along the Said narrow Slipe of ground one hundred and two feet three inches, to the South West Corner of J. Forts Lot No. 8_ and from thence along the West end of No. 8 & No. 7. to the Beginning _ To have and to hold the Said lot with its appurtenances to the said J. Fort. and his heirs forever. And the Said Joshua Fort doth Covenant and agree in manner and form following Viz. That he his heirs ex'ors or adm'rs Shall and will, build on the Said lot No. 9, a .dwelling house, Sixteen feet Square at least with a brick or Stone Chimney, to be finished fit for habitation in ten years from the Seventh day of Decr. one thousand eight hundred and one, agreeable to the last act of assembly; allowing further time for building on the Said lots; which act bears date the third day of January 1803_ and also to pay punctually (if not paid) the money arising from the Sale of the Said lot, to the former proprietors thereof, or their legal representatives; and the said Trustees do Covenant, and agree to and with the said J. Fort, that they will perform on their part, all which they ought to perform; and the said Joshua Fort his heirs or assigns may peacably & quietly enter upon, have, hold, and enjoy, the said lot No. 9_ and the appurtenances thereto belonging_ provided the said Fort doth Comply with the aforesaid Covenant; but Should he fail therein then the Said Trustees may immediately enter into and make Sale of the aforesaid lot, pursuant to the act of Assembly passed the 7th. COBB was named trustee in a deed of trust from Stephen BARHAM, for the benefit of Samuel WALLACE, 25 Jan 1808 (15 Feb 1808).
