Witnesseth that whereas the Said William Lawrence, & Timoty Tynes did on the 16th day of the present month January & of the above mentioned year become the said Moses Johnson Security in Seven different Bonds to Arthur Holleman, & John Harris (as Commissions to sell the tract of Land that (Benjamin Britt dec'ed died Seized & possessed for the sum of one hundred, & fourteen dollars, & twenty nine Cents, each Bond, payable the 16th day of Octr. next making in the whole eight hundred dollars which will fully appear by having reference to Said Bonds. And the Said Moses Johnson honestly desiring to Secure the Said William Lawrence & Timoty Tynes & their Heirs &C. And indemnify them against any injury that they or either of them, or their heirs &C. may sustain by their becoming bound as Security aforesaid, and for and in Consideration of the Sum of one Dollar to the said moses Johnson in hand paid by the said William Lawrence and Timothy Tynes at or before the signing, Sealing, & delivery of these presents, the receipt whereof the sd. Moses Johnson doth hereby acknowledge. hath granted bargaining and sold, and by these presents doth gran[t] bargain & Sell and confirm unto the said William Lawrence & Timoty tynes, & to their heirs &C one Certain tract of Land, situate lying in the County of Southampton aforesaid Containing two hundred acres, more or less it being the land sold by the aforesaid Commissioners, & whereon the late Benjamin Britt deceased formerly lived. together with one Gray Mare one Cow & calf, two beds & furniture, with all the appurtenances belonging or in any wise appertaining to the premises and other property hereby gran =ted, or intended to be granted, & the revision & revisions, remainder & remainders, and all services benifits of the said Land, and other proper[ty] above mentioned all my right and claim Interest & demand whatsoever to the same __ To have & to hold the said tract or parcel of Land and other property above mentioned & every part thereof unto the said William Lawrence & timoth Tynes their heirs and assigns forever and the said moses Johnson doth by these presents bind [page break] [p.] 5 himself his heirs &C to warrant and forever defend this his Sale of Land &C above named to them the said William Lawrence & Timothy Tynes or either of them, or their heirs; executors or administrators shall suffer, or likely to suffer in Consequence of their becoming Security as aforesaid in either of these cases the said William Lawrence, & Timothy Tynes or their heirs &C Shall direct William Bailey the third person mentioned, after given reasonable notice proceed to sell publick ^ Sales, for readay Money, the Land, & other property as above menti =oned or as much thereof as will be sufficient, to pay & satisfy whatever sum , or sums they William Lawrence & Timothy tynes, &C may have suffered, or be likely to suffer in Consequence of their being Security, as aforesaid, and the said William Bailey shall have a right to convey the same to the purchaser in fee simple, & after paying & satisfying the aforesaid William Lawrence, & Timoty Tynes &C whatever Sums they or either of them, &C may have suffered, or likely in Consequence of the being security as aforesaid and also the charge of drawing & recording this Indenture the Con =tingent Charges of the sale & other necessary expences thereunto relating, & the overplus if any, to be by the aforesaid William Bailey delivered unto the said Moses Johnson his heirs &C.
