All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Southampton County Virginia USGenWeb Archives Land Records Timothy ATKINSON to William BAILEY, for John URQUHART, deed of trust, 335 acres, 8 May 1811 (Nov 1811) [margin note] Atkins to Urquhart This Indenture made 8th day of May One thousand eight hundred and eleven Between Timothy Atkinson of the first part, John URquhart of the second part, and William Bailey of the third part Witnesseth, by these presents, that the said Timothy Atkinson for and in Consideration of the sum of One Dollar to him in hand paid by the said William Bailey, the receipt whereof he the said Timothy Atkinson, doth hereby acknowledge, hath, granted bargained, and sold, aliened released and Confirmed, by these presents doth grant, confirm and sell alien, release unto the said William Bailey, his heirs and assigns forever, all the Plantation tract or parcel of land lying and being in the county of Southampton (and Parish of Nottoway) which tract or parcel of land and plan= =tation, the said Timothy Atkinson now lives on Containing by estimation 335 Acres more or less Bounded by the lands of said Urquhart, Simon Boykin, & on the other part by the most antient, Known and reputed bounds of the said tract or parcel of land, and also the reversion and reversions remainder, and remainders, rents and issues thereof, and of every part & parcel thereof. To have and to hold, the said tract or parcel of land, and Premises, with the appurtenances thereunto belonging unto William Bailey, his heirs and assigns forever to the Only proper use and behoof of him the said William Bailey, his heirs and assigns forever upon the special trust and confi= =dence, nevertheless that whareas the said Timothy Atkinson is justly Indebted to the said John Urquhart the sum of Seventeen hundred and eighteen Dollars and being willing and anxious, to secure the Same, now if that the said Timothy Atkinson his heirs &C Should fail to Pay, or discharge the above debts of seventeen hundred and eighteen Dollars on or before the 25th day of December next with lawfull Interest thereon that, in, that case the said William Bailey his heirs ex'ors or admrs. shall sell at Publlick sale, after giving reasonable Notice, the lands and Plantations, herein before mentioned, for the best price that can be gotton and the blance of the purchase money if any after paying the before mentioned debt, Interest and all the expenses, attending the same or the full execution of this deed in trust, shall be paid unto Timothy Atkinson his heirs and &c by the said William bailey his heirs &c as trustee._ In Witness whereof the parties have hereunto set their hands & seals this 8th day of May one thousand eight hundred and eleven Signed Sealed & delivered Timothy Atkins ĪSealĪ in the Presence of S. Boykin and George B. Cobb two of the witnesses hereto and continued, and at a court held for the said County of Southampton the day of December 1811 This deed in trust was further proved by the Oath of Bassett M. Calvert another Witness hereto (after been before proved by two other Witness and ordered to be recorded Southampton Co., VA, Deed Book 12 (1808-12), pp. 375-76 The Library of Virginia (LVA), Richmond, VA, Southampton Microfilm Reel 6 OB1811-12:11-12 At a court of quarter Session held for the county of Southampton the 18th. day of November 1811 [...] Deed in trust between Timothy Atkinson of the one part and William Bailey of the other part for the benefit of John Urquhart was acknowledged by William Bailey and John Urquhart and proved by the oaths of Simon Boykin and George B. Cobb two of the witnesses hereto as to Timothy Atkinson party hereto and continued / [...] Southampton Co., VA, Court Order Book 1811 - 1812, pp. 11-12 The Library of Virginia (LVA), Richmond, VA, Southampton Microfilm Reel 29 Timothy's surname appears variously as ATKINS or ATKINSON, often in the same document, as above.
