Stringfield and wife at or before the sealing and delivery of these Presents the receipt whereof the said Timothy Tines and wife doth hereby acknowledge themselves therewith to be fully satisfied and paid [page break] [p.] 239 and thereof doth clearly acquit and discharge the said William Stringfield and wife their heirs executors and admrs. forever by these Presents, hath given granted bargained sold enfeoffed & confirmed and by these Presents doth give grant bargain sell enfeoff and confirm unto the said William Stringfield and wife their heirs exors. and assigns forever, one certain tract or Parcel of land containing by survey fifty seven & two thirds acres be the same more or less lying and being in the County of Southampton, and bounded as followeth Vizt. begining at a pine corner tree of Arrington Britt William Crumpler and Timothy Tynes line thence South S. West a line of marked trees to William Crumpler and Timothy Tynes's line, thence South East a line of marked trees of William Crumpler, Beazant Crumpler and Timothy Tynes's line to a cedar corner tree of Beazant Crumpler Timothy Tynes and Martha Tynes's line from thence North East line of marked trees of Timothy Tynes and Martha Tynes line, to a Pine, corner tree of Timothy Tynes and Martha Tynes's line on the bank of Black water river thence North up said river to the King spring branch, thence North East up the said branch to the first station, with all houses orchards gardens fences woods underwoods waters and watercourses and with all Profits commodities, advantages emoluments and appurtenances whatsoever Part and parcel thereof _ To have and to hold the said trant and parcel of land with all and singular the appurtenances unto the said William Stringfield and wife their heirs and assigns, to the only proper use and behoof of them the said William Stringfield and wife their heirs and assigns forever, and the said Timothy Tynes and wife for themselves and their heirs, the said granted land with its Premises and their and every of their appurtenances unto the said William Stringfield and wife their heirs and assigns shall and will warrant [page break] [p.] 240 and forever defend by these Presents against any Person whatsoever haveing or lawfully claiming right title property or interest in or to the same or any Part thereof or Parcel and the said Timothy Tynes and wife for themselves and their heirs doth grant consent and agree to and with the said Wm. Stringfield and wife their heirs, and assigns in manner and form following Vizt. the said Timothy Tynes and wife at the time of the sealing and delivery of these presents is, and stands seized of an indefesible estate in fee simple of in and to the Premises and that they have good right and lawful authority to sell convey the same in manner and form aforesaid and that the same shall forever remain to the said Wm. Stringfield and wife their heirs and assigns freely and clearly exonerated and discharged of, and from all manner of Bargains, sales and titles of dowry and all other rights and estates whatsoever _ In Witness whereof the said Timothy Tynes & Wife hath hereto set their hands and affixed their seals the day and year above written _ Signed and acknowledged } Timothy Tynes ĪSealĪ In the Presence of } her Samuel Calvert Jr. Rebecca x Tynes ĪSealĪ W. Boykin = The Commonwealth of Virginia to William Bailey and Simon Boykin gentlemen justices of the Peace for the county of Southampton greeting whereas Timothy Tynes and Rebecca his wife have by their certain Indenture of bargain and sale bearing date the 9th day of December conveyed unto William Stringfield of the county of Southampton the fee simple estate of and in a certain tract or parcel of land situate lying and being in the county of Southampton containing by estimation fifty seven acres and 2/3 of an acre be the same more or less and whereas the said Rebecca cannot conveniently travel to the Court of our said county to acknowledge the same therefore we do give to your Power to receive the acknowledgment which the said Rebecca shall be willing to make before you of the conveyance [page break] [p.] 241 aforesaid contained in the said Indenture which is hereto annexed and we do command you to go Personally to the said Rebecca and examine her Privately and apart from her said husband whether she hath executed the said Indenture freely and voluntarily without the Pursuasion or threat of her said husband and whether she is willing the same should be recorded in the county court of Southampton and when you have examined her as aforesaid and taken acknow= =ledgment of the said Indenture that you distinctly and openly certify us thereof under your hands and seals returning to us also this writ with the said Indenture annexed Witness Saml. Kello clerk of our said court at his office the 27th day of November 1812 in 37th year of the Commonwealth __ Saml. Kello In conformity to the within Commission to us directed We have examined the within mentioned Rebecca Tynes privily and apart from her husband whether she signed the annexed Indenture freely and voluntarily without the threat's or Pursuasion's of her said husband and also whether she is willing the same should be recorded in the county court of So.ampton to which queries she answered that she signed the annexed Indenture voluntarily and was willing the same should be recorded in the court aforesaid, given under our hands and seals this 9th day of December 1812 __ W.
