(COCKE) HENLEY, to Simon BOYKIN, deed of bargain & sale, undivided interest in COCKE's plantation, 8 Sep 1813 (Jan 1814) [margin note] Coleman to Boykin Whereas Robert Cocke deceased of the county of Surry died seized of a certain tract or parcel of land lying in the county of Southampton called and known by the name of Cockes's Planta _tion and whereas the said Robert Cocke died intestate leaving and infant daughter Martha R. Cocke heiress of the estate of the said Robert Cocke and whereas the said infant Martha since intermarried with Bartholomew D. Henley and died under lawful age without issue and the said tract or Parcel of land reverting to the heirs at law of the said Martha and Da =niel Coleman and Martha his wife being entitled to a certain undivided Proportion or intrest in the said tract or parcel of land and being desirous of selling their interest therein Now This Indenture made this eighth day of September in the year of Christ one thousand eight hundred and thirteen between Daniel Coleman and Martha his wife of the county of Caroline of the one part and Simon Boykin of the county of Southampton of the other part Witnesseth that the said Daniel Coleman and Martha his wife for and in Conside =ration of the sum of five hundred dollars unto them in hand paid by the said Simon Boykin at or before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained sold aliened and confirmed and by these Presents doth grant bargain sell alien and confirm unto the said Simon Boykin all their right title and interest it being one fifth part of the said undivided tract or Parcel of land lying in the county of Southampton, of which Martha R. Henley died seized, to have and to hold the said right title and Interest of them the said Daniel Coleman and Martha his wife of in or to the said undivided Proportion'd tract or Parcel of land [page break] [p.] 14 known by the name of Cockes's unto him the said Simon Boykin his heirs and assigns forever and the said Daniel Coleman and Martha his wife for themselves and their heirs their said right title and interest of in and to the said undivided Portion in the said tract or Parcel of land will forever warrant and forever defend unto the said Simon Boykin his heirs and assigns _ In testimony whereof the said Daniel Coleman and Martha his wife have here =unto set their hands and affixed their seals the day and Year first above written __ Signed Sealed and delivered} } In Presence of ________ } } Wm. Coleman Gentlemen Justices of the peace for the county of Caroline greeting whereas Daniel Coleman and Martha his wife of the county of Caroline by their certain Indenture of bargain and sale bearing date the 8th. day of September 1813 have sold and conveyed unto Simon Boykin of the county of Southampton one certain tract or Parcel of land as mentioned in the deed hereto annexed with the appurtenances lying and being in the county of Southampton and whereas the said Martha cannot con =veniently travel to the court of our said county to make acknowledgment of the said conveyance therefore we do give unto you Power to receive the acknowledgment which the said Martha shall be willing to make before you of the conveyance aforesaid contained in the said Indenture which is hereto annexed and we command you that you do Personally go to the said Martha and receive her acknow =ledgment of the same and examine her Privately and apart from her said husband whether she hath executed the same freely and Voluntarily without the Pursuasion or threat of her said husband and whether she be willing that the same [page break] [p.] 15 be recorded in the court of our said County of Southampton aforesaid and when you have received her acknowledgment and examined her as aforesdaid that you distinctly and openly certify us thereof under your hands and seals sending to us also this writ with the said Indenture hereto annexed _ Witness Saml. Kello Clerk of our said Court at his office the 21st. day of September 1813 and 38th. year of the Commonwealth ________ James Rochelle D.C. ________"_______ Pursuant to the within Commission directed to us two of the Justices of the peace for the county of Caroline we have this day examined greeting the said Martha Coleman seperately and apart from her said Husband the within named Daniel Coleman who made her acknowledgments to the tract of land mentioned in the deed hereto annexed and said she did the same freely and voluntarily without the Pursuasion or threats of her said husband and that she is willing the same should be recorded in the county court of Southampton __ Given under our hands and seals this 1st. day of December 1813 __ Geo.
