All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Southampton County Virginia USGenWeb Archives Land Records Samuel WHITFIELD & wife Elizabeth DREW WHITFIELD and George WILSON & wife Mary "Polly" DREW WILSON to Robert ADAMS, deed of bargain & sale, 180 acres, 10 Jun 1817 (18 Aug 1817) [margin note] Whitfield & Wilson To Adams This Indenture made this tenth day of June, in the year of our Lord, eighteen hundred and seventeen, between Samuel Whitfield and Elizabeth his wife, and George Wilson and Mary his wife of the Town of Smithfield and the County of Isle of Wight of the one Part, and Robert Adams of the County of Nansemond of the other part: Witnesseth that the said Samuel Whitfield and Elizabeth his wife, and George Wilson and Mary his wife, for and in consideration of the sum of seven hundred dollars, to them in hand paid or secured to be Paid, by the said Robert Adams, at or before the ensealing and delilvery of these presents, the receipt whereof is hereby acknow =ledged, have bargained and sold, and by these presents do bargain and sell unto the said Robert Adams a certain tract or parcel of Land, lying and being in the County of Southampton just above the lower Seacock bridge, it being all the Land which John Wright late of the County of Southampton, died seized and possed of, which said Land was sold by a decree of the County Court of Southampton, and William Boykin became the Purchaser, and gave the said Land to his grand Daughters, Elizabeth and Mary Drews, Containing by estimation one hundred and eighty acres, be the same more or less, the bounds of which may be found by a reference to the Deed from the Commissioners appointed by the Court, to sell the said Land, together with all and Singular the appurtenances thereunto belonging, and the reversion and reversions, remainder and Remainders, issues and profits thereof, and of every part [page break] [p.] 303 and parcel thereof, To have and to hold the said Land, the Tenements, Hereditaments, and all and Singular other [the] pre =mises herein before mentioned or intended to be bargained and sold, and of every part and Parcel thereof, with every of their rights members, and appurtenances unto the said Robert Adams his heirs and assigns forever; and the said Samuel Whitfield and Elizabeth his wife, and George Wilson and Mary his wife for themselves and their heirs, the said Land with all and singular the Premises and appurtenances before mentioned, or intended to be bargained and Sold, unto the said Robert Adams his heirs and assigns, free from the claim or claiming of them the said Samuel Whitfield and Elizabeth his wife and George Wilson and Mary his wife, or either of them, their or either of their heirs, and of all and every person or persons whomsoever, shall, will & do warrant and forever defend by these Presents; In Witness whereof the said Samuel Whitfield and Elizabeth his wife, and George Wilson and Mary his wife, have hereunto set their hands and seals the day and year first above Written. Woodley, Justices of the Peace in the County aforesaid in the state of Virginia do hereby certify, that Samuel Whit _field and Elizabeth his wife, and Parties to a certain Deed for the conveyance of real estate, to Robert Adams, bearing date the tenth day of June . . . . . and hereto annexed, per _sonally appeared before us in our County aforesaid, and the said Elizabeth Whitfield within being examined by us privily and apart from their husbands, and having the Deed aforesaid fully explained to them, the said Eli _zabeth Whitfield within declared she had willingly signed sealed and delivered the same, without any threat or persuasion from her husband, and they as well as their husbands, Samuel Whitfield, and George Wilson, desired us to certify this there conveyance to the Clerk of the County Court of Southampton, in order that the same may be recorded, Given under our hands and seals this 10th. day of June 1817. This Indenture having been certified as to acknowledgements of the said Saml. Whitfield and George Wilson as well the privy examination of the said Elizabeth Whitfield wife of the said Samuel Whitfield, was this day returned and admitted to Record: And at a Court held for the County of Southampton the 18th. day of Augt. 1817. This Indenture with the certificate of Isham Jordan, Benja. Drew & Saml. Woodley, were entered upon the proceedings thereof In Pursuance of an Act of Assembly in such Case made and Provided Teste James Rochelle c.c. ______"____________ // Southampton Co., VA, Deed Book 15 (1816-18), pp. 302-04 The Library of Virginia (LVA), Richmond, VA, Southampton Microfilm Reel 7 Mary "Polly" (DREW) WILSON was still a minor 10 Jun 1817, when this deed was executed, so she was legally unable to acknowledge it. The grantees also executed another deed (DB15:302-04) the same day, to Mills ELEY of Isle of Wight Co., conveying the adjoining 723-acre BOYKIN Quarter tract mentioned above. That deed was defective- lacking Mary's acknowledgement & relinquishment of dower right; it is posted at: http://files.usgwarchives.net/va/southampton/deeds/15db302.txt She and her husband George executed a second deed (DB18:487-89) to rectify the defect, which is posted at: http://files.usgwarchives.net/va/southampton/deeds/18db487.txt This deed must be similarly defective, but no similar corrective deed to ADAMS appears in the Southampton Co. records.
