All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Southampton County Virginia USGenWeb Archives Land Records Samuel WHITFIELD & wife Elizabeth DREW WHITFIELD and George WILSON & wife Mary "Polly" DREW WILSON to Mills ELEY, deed of bargain & sale, 753 acres, 10 Jun 1817 (15 Dec 1817) [margin note] Whitfield &wf & Wilson &wf To Eley Examined & delivered to Silas Summerell Sept. 1/1820 This Indenture made this tenth day of June in the year of our Lord, eighteen hundred and seven_ _teen Between Samuel Whitfield and Elizabeth his wife and George Wilson and Mary his wife all of the Town of Smithfield, and County of Isle of Wight, of the one part, and Mills Eley of the County of Isle of Wight of the other part, Witnesseth, that the said Samuel Whitfield and Elizabeth his Wife, and George Wilson and Mary his wife, for and in Consi_ _deration of the sum of Three thousand dollars to them in hand paid or Secured to be paid, before the ensealing and delilvery of these presents, the receipt whereof is hereby acknowledged, have bargained and sold, and by these presents do bargain and sell unto the said Mills Eley his heirs and Assigns, a certain tract or parcel of Land, lying and being in the County of Southamp _ton. Known by the Name of William Boykins Quarter On the Main road leading from the middle to the lower Seacock Bridge, it being the balance of the said Quarter plantation (after taking off the lower end Called Wrights place) which Said Land the late William Boykin, gave to his granddaugh_ _ters, Elizabeth and Mary Drews, who have since intermarried with the sd. Samuel Whitfield and George Wilson and are parties to this con_ _veyance, Containing by estimation agreeable to the Commissioners' Report, who were appointed by the County Court of Isle of wight, to divide the land, belonging to the estate of the said William Boykin, Seven hundred and fifty three acres, be the same more or less, and bound in the following manner, To wit, by the lands of Robert Hart, Benjamin Crumpler and Thomas Turner, on the East, by the land above mentioned called Wrights place, On the [page break] [p.] 353 Exd. South to the Main run of Seacock Swamp, thence up the main run of said swamp, to Jesse Lowes line, thence along the said Lowes line to the main run of the Said swamp again, thence up the main run of Said swamp to the Mouth of Tarripin Branch in Major Simon Boykins line, thence up the main run of the said Branch near the main road thence across the Said road to the beginning together with all and Singular the appurtenances thereunto belonging, and the reversion and reversions, remainder and remainders, issues and profits thereof, To have and to hold the said land, the Tenements, Hereditaments, and all and Singular other the premises herein before mentioned, or intended to be bargained and sold and of every part and parcel thereof, With every of their rights members and appurtenances unto the Said Mills Eley his heirs and assigns forever, and the said Samuel Whitfield and Elizabeth his wife, and George Wilson and Mary his wife for themselves and and their heirs the Said Land with all and Singular the prem_ ises and appurtenances before mentioned, or intended to be bargain _ed and Sold unto the Said Mills Eley his Heirs and assigns free from the claim or claims of them the said Samuel Whitfield and Elizabeth his wife and George Wilson and Mary his wife or either of them, their or either of their heirs, and of all and every Person whomsoever, shall, Will and do Warrant and forever defend by these presents; In Witness whereof the Said Samuel Whit_ _field and Elizabeth his Wife, George Wilson and Mary his Wife have hereunto set their hands and Seals, the day and year first above Written. Woodley, Justices of the Peace in the County aforesaid in the State of Virginia do hereby certify, that Samuel Whitfield and Elizabeth his Wife, and George Wilson Parties to a certain Deed for the conveyance of real estate to Mills Eley bearing date the 10th. day of June 1817. and hereto annexed per_ _Sonally appeared before us in our County aforesaid and the said Elizabeth Whitfield being examined by us privily and apart from her husband, and having the deed aforesaid fully explained to her, she the said Elizabeth Whitfield declared that she had willingly Signed, Sealed and delivered the Same without any threat or persuasion of her husband, and she as well as the Said Samuel Whitfield and George Wilson desired that We Would certify the Same to the Clerk of the County Court of Southampton, in Order that the Said Conveyance may be Recorded_ Given under our hands and Seals this 10th. This Indenture with the certificate of Isham Jordan, Benja. Drew & Saml. Woodley Magistrates for the County of Isle of Wight, certifying the acknowledgement of the within named Samuel Whitfield & Elizabeth wife the said Samuel and George Wilson parties hereto, as also the privy examination of the said Elizabeth was this day retur_ _ned and admitted to Record_ And at a Court held for the aforesaid County of So..ton the 15th. day of December 1817. This Indenture and certificate as aforesaid were entered upon the proceedings thereof In pursuance of an act of Assembly in Such Case made and provided Teste James Rochelle c.C. _______"_______ Exd. // Southampton Co., VA, Deed Book 15 (1816-18), pp. 352-54 The Library of Virginia (LVA), Richmond, VA, Southampton Microfilm Reel 7 Mary (DREW) WILSON was still a minor 10 Jun 1817, when this deed was executed, so she was legally unable to acknowledge it. She and her husband George executed a second deed (DB18:487-89) to rectify the defect, which is posted at: http://files.usgwarchives.net/va/southampton/deeds/18db487.txt The grantees also executed another deed (DB15:302-04) the same day, to Robert ADAMS of Nansemond Co., conveying the adjoining 180-acre WRIGHT tract mentioned above. That deed must also have been defective, but no similar acknowledgement appears in the Southampton Co. records.
