Boykin Commissioners &C. of the one part and William Bowden of the other both of the county of Southampton. Witnesseth that the said Simon Boykin, Willis Bowers and Samuel G. Boykin commissioners &C for the Consideration of the Sum of one hundred and fifty one Dollars lawful money of Virginia to them in hand paid by the said William Bowden before the Signing Sealing and delivery of these presents. the receipt whereof the said Simon Boykin Willis Bowers, and Saml. G. Boykin, commissioners &C do hereby acknowledge themselves fully Satisfied, contented and paid have bargained and Sold, aliened enfeoffed & confirmed and by these presents doth hereby bargain Sell and enfeoffed & confirmed unto the Said William Bowden his heirs and assigns a certain tract or parcel of land lying & being in the county of Southampton which land Joseph Britt of John died Seized and possessed of and was Sold at publick auction by Virtue of an order of the worshipful court of Southampton [page break] [p.] 125 bounded as follows to wit, bounded by the lands of William Bowden Beasant Britt and Timothy Tynes, containing thirty Acres. be the Same more or less together with all houses, profits & commodities thereto belonging or in any wise appurtaining with all the Est. right, title & interest claim or demand of them the said Simon Boykin Willis Bowers and Samuel G. Boykin Commissioners to have and to hold the said bargained premises with every of the appurtenances unto the sd. William Bowden his heirs and assigns forever And they the said Simon Boykin Willis Bowers & Samuel G. Boykin commissioners quits claims and releases unto the said William Bowden his heirs &C forever all the right title & interest that is vested in them by Virtue of an order of the worship= =ful Court of So.ton bearing date December court 1818 [sic*] to the Said bargained premises. And at a court held for the said County on day of October 1818 This Indenture as aforesaid was entered upon the proceedings of the day. Justices Rebecca Britt widow and relict of Joseph Britt deceased (of John) Complaintants against } Henry Britt Elias Britt and Lawrence Britt infant } In Children and heirs at law of Joseph Britt decd. (of John, } Chy. by William Bowden their next friend appointed by } the Court to defend them in this behalf Defendants } This Cause was this day docketed by Consent of parties and assent of the Court and was heard on the bill and answer and argument of Counsel and after mature deliberation, the Court doth adjudge and decree that Simon Boykin, Samuel G. Boykin, John Crumpler and Willis Bowers, or any three of them, do after giving three weeks notice of the time and place of sale expose the tract of land [mentd.] in the bill whereof Joseph Britt (of John) died seized and possessed lying in this County, to public sale on a Credit of nine months [That] they assign one Sixth part of the proceeds of the sale to the Compla[intant] Rebecca Britt in lieu of her dower in the said tract of land the payment thereof to be secured to her by bond with approved security taken from the purchaser, That they assign to each of the defendants Henry Britt, Elias Britt and Lawrence Britt on equal third[?] of the balance of the proceeds of the sale of the said land the payment thereof to be secured by bonds taken from the purchaser with approved security, and assign to the guardian or guardians of the said Henry, Elias and Lawrence Britt, That they make a good and sufficient Conveyance of said land to the purchaser or purchasers in fee simple and they or such of them as may act make a report to this Court [in] order to a final decree ~ // [...] OB1816-19:436-37, 442 At a Court of Quarter session held for the County of Southampton on the 21st. day of September 1818 [...] Drew Plt. } ags. } In debt Britt Deft.} Willis Bowers of this County here in Court undertakes for the defendant in Case he shall be Cast in this Suit he shall pay and satisfy the Condemnation[?] of the Court or rendere his body. to prison in execution for the same or [that] he the said Willis Bowers will do it for him. ~ // [...] Rebecca Britt widow and relict of Joseph Britt decd. of John _ Complt} ags. } In Henry Britt, Elias Britt and Laurince Britt, infant children } Chy. and heirs at Law of Joseph Britt (of John), by William Bowden } their next friend appointed by the Court to defend them in this behalf -Deft.} The persons appointed heretofore Commissioners to make partition and division of the Estate of Joseph Britt (of John) this day made their report in the following words and figures, To wit, "In Obedience to an order of the worshipful Court of Southampton bearing date december Court 1817 we the undersigned have sold at public auction the land wich Joseph Britt (of John) died seized and possessed of William Bowden became the purchaser and gave bond with approved securety to each legatee payable in nine months. given under our hands this 27th. day of February 1818, Simon Boykin Willis Bowers, Samuel G.
