All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Southampton County Virginia USGenWeb Archives Deeds Henry "Harry" OBERRY (Jr.) & bro Alfred OBERRY to trustee James SCOTT, for the benefit of Ann (SCOTT) PRETLOW, deed of trust, 34 acres, 28 Apr 1820 (5 Jun 1820) [margin notes] [p.] 309 Oberry to Scott for Pretlow Ex.d & sent to James Scott 20.th Oct.r 1823 This Indenture made this twenty eight day of April one thousand eight hundred and twenty Between Henry Oberry and Alfred Oberry of the County of Southampton and State of Virginia of the one part Ann Pretlow of the said County and state of the second part and James Scott of the aforesaid county of Southampton and State of Virginia of the third part Witnesseth that whereas the said Henry Oberry Stands Justly indebted by a note of hand to the Said Ann Pretlow in the Sum of one hundred and twenty five dollars current money of the United States of America and whereas for the further assurance of the payment it is agreed by the parties hereto that a Conveyance in trust Shall be made to the Said James Scott for the benifit of of [sic] the Said Ann Pretlow in case the Sum on the Said Note of hand Shall not be punctually paid with Lawfull interest thereon on or before the first day of December next Now this indenture Witnesseth that the Said Henry Oberry and Alfred Oberry for and in codsideration [sic] of the premises and for the further Sum of One Dollars to them in hand paid the receipt of which is acknowledged. have bargained and Sold and by these presents do for themselves their heirs executors and administrators give grant bargain and Sell unto the said James Scott his heirs and assigns all the land that now. in any wise belongs to the Ssaid Henry Oberry and Alfred Oberry in Southampton County being a part of the tract of Land devised by Henry Oberry decd. to his Sons the aforesaid Henry Oberry and Alfred Oberry on which the last mentioned Henry. Oberry now lives containing by estimation thirty four Acres be [margin note] Ex.d the Same more or less bounded by the Known and reputed bounds thereof also all the buildings woods waters advantages and appurtanances to the Same in any wise belonging and the reversions remainders rents issues and profits thereof _ and all the estate right. & title of them the Said Henry oberry and Alfred obberry [sic] of in and to the Same and every part. and parcel thereof. To Have and to hold. the above granted and bargained | premises with every of the appurtanances unto the said James Scott his heirs and assigns in trust forever And it is hereby declared to be the true intent and meaning of these presents that if the Said Henry Oberry Shall punctually pay unto the Said Ann Pretlow her heirs or assignS the said Sum of One hundred and Twenty five dollars and interest agreeable to the tenor of the said Note ofhand to the said Ann Pretlow, then the said James Scott his heirs and assigns Shall hold ['the said Land' obscured] above granted to the sole and proper use ['and behoof of' obscured] the Said Henry [page break] [p.] 310 Henry Oberry and the said James Scott covenants and agrees with the parties hereto that in case the said Henry Oberry his heirs Executors and administrators Shall fail to make payment to the Said Ann Pretlow her heirs and assigns on or before the first day of December next the Sum due on the note of hand aforesaid that then the said James Scott his heirs and assigns shall Stand seized of the above granted and bargained premises for the purposes follo= wing that is to Say that at the request of the Said Ann Pretlow her heirs Executors and administrators or assigns he the said James Scott his heirs executors administrators and assigns or either of them Shall give Twenty days Notice and Sell at publick sale the above mentioned Land and Shall pay the money arising therefrom to the Said Ann Pretlow her heirs Executors administrators or assigns so far forth as Shall be then due and after Satisfying the Said Note of hand interest and all the expenses arising or remaining from [margin note] Ex.d the Notice and Sale &C Shall pay the surplus money to the said Henry Oberry or his assigns In Witness whereof the parties have hereunto Set their hands &Seals the day and Year first above written Signed Sealed and delivered Henry Oberry ĪSealĪ in presence of Mills Beal his Lamuel Beal Alfred x Oberry ĪSealĪ his mark Benjamin + B.
