Feby. 1822 This Indenture made and entered into this 8th. day of November one thousand eight hundred and twenty Between Timothy Tynes of the one part Harrison Stephenson administrator of Temperance Turner deceased of the other part and Thomas Pond of the third part all of the County of Southampton and State of Virginia. Whereas the Said Timothy Tynes for and in consideration of the Sum of one hundred and thirty Dollars and Ninety three cents which he justly Owes to the Said Harrison Stephenson as well as all other debts or sums of money that may become due or owing to the said Harrison Stephenson from the said Timothy Tynes by reasons of any dealings transactions transfer of debt of any nature or Kind whatever as also for and in consid= eration of the sum of one dollar to him in hand paid by the Said Thomas Pond the receipt Whereof the Said Timothy Tynes doth by these presents hereby acknowledge doth grant bargain Sell Convey and make over and by these presents hath granted bargained Sold Conveyed and made over unto the Said Thomas Pond and his heirs forever one certain tract or parcel of land Containing by estimation Seventy two acres be the Same more or less and Bounded by the lands of Robert Mercer William Bowden and ["John" overwritten] Robert Adams To have and to hold together with all right and interest of him the Said timothy Tynes herein Conveyed or intended to be conveyed unto him the said ["Timothy" overwritten] Thomas Pond his heirs Ex'rs adm'rs and assigns forever upon this Special Trust ["and Confidence" struck] nevertheless the said Thomas Pond upon being thereto required by the Said Harrison Stephenson shall proceed to sell the aforesaid Tract or parcel of land and all the right and interest thereon herein Conveyed or intended to be conveyed after advertising the time and place of sale in the said County of Southampton for ten days previous at Some publick place in said County for cash and out of the money arising from said sale in the first place pay and satisfy all cost attending the said sale as well as the expenses of the Said Conveyance and then pay unto the said Harrison Stephenson the aforesaid sum of one hundred thirty dollars and ninty three Cents with interest from the date of these presents and the overplus if any pay unto the said Timothy Tynes and the said Timothy Tynes for himself his heirs Executors & administrators the right and title to the Said tract or parcel of land unto the said Thomas Pond his heirs and assigns doth hereby forever warrant and defend against the lawfull Claim or Claims of him the Said Timothy Tynes his heirs Executors administrators or assigns and all and every other person or persons whomsoever and the said Thomas Pond on his part Covenants and agrees that he will make sale of the property herein Conveyed for the best price he can obtain for the Same after advertising the time and place of Sale for ten days at Some publick place in the aforesaid County and with the money arising from the Said Sale on the first pay and Satisfy all cost attending the Same [page break] [p.] 88 as well as the expenses of this Conveyance and then pay unto the said Harrison Stephenson the afores= =aid sum of One hundred thirty dollars and ninety three Cents with legal interest from the date of these presents and the overplus if any pay over to the Said Timothy Tynes and the said Harrison Stephenson on his part Covenants and agrees that he will release the Said Timothy Tynes from the Obligation of this incumberance upon being paid the aforesaid Sum of One hundred thirty dollars and ninety three Cents with interest from the date of this instrument In witness Whereof the parties to these presents have hereunto Set their hands and affixed their Seals the day and Year above written Signed sealed and delivered in Presence of M. This indenture was proved by the oaths of M.M. Eley Jesse Balley and William Hancock and Zebulon Eley the witnesses thereto and admitted to record And at a Court held for the aforesaid County of Southampton on the 16th day of April 1821 This indenture As aforesaid was intered upon the proceedings of the day Teste: James Rochelle c Southampton Co., VA, Deed Book 18 (1821-22), pp. 87-88 The Library of Virginia (LVA), Richmond, VA, Southampton Microfilm Reel 8 Timothy paid his debt to Harrison STEPHENSON, so Thomas POND executed a deed of release 5 Dec 1821, returning this tract to TYNES.
