JENKINS, for the benefit of Simon BOYKIN, deed of trust, Negro girl Cassell, 16 Jun 1821 (19 Nov 1821) [margin note] Britt to Jenkins Exd. & Deld. to Spencer R. Jenkins 25th June 1823 This Indenture made this 16th day of June in the year of our Lord christ one thousand eight hundred and twenty one between Joseph Britt of the first [part] Spencer R. Jenkins of the second part and Simon Boykin of the third part Whereas the said Joseph Britt is justly indebted to the said Simon Boykin in the sum of three hundred and seven dollars and twenty five cents to be paid on or before the first day of January next as by Bond &C[?] will more fully appear which debt with the legal interest thereon accruing the said [page break] [p.] 276 Joseph Britt is willing and desirous to secure Now this Indenture. Witnesseth that for and in consideration of the premises and also for the further Sum of one dollar of lawfull money of Virginia to the said Joseph Britt in hand paid by the said Spencer R. Jenkins at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged he the said Joseph hath given granted bargained sold and Confirmed and by these Presents doth give grant bargain sell and Confirm to the said Spencer R. Jenkins his heirs and assigns forever one negro girl by the name of Cassell[?] about ninteen. years old and her furture increase and all the estate right title & interest of the said Joseph Britt in and to the said Negro girl Cassell and her increase To have and to hold the said granted or intended to be granted negro girl Cassell and her future increase to the said Spencer R. Jenkins his heirs Executors administrators and assigns forever to the only proper use and behoof of the Said Spencer R. Jenkins his heirs Executors & assigns forever and the said Joseph Britt for himself his heirs Ex'or and administrators doth hereby covenant promise and agree to and with the said Spencer R. Jenknins his heirs Executors and adm'r and assigns forever in manner and form following that is to say that the Said Joseph Britt his heirs Executors and administrators that the aforesaid negro girl Cassell and her future increase unto the said Spencer R. Jenkins his heirs Executors administrators and assigns against all persons whatsoever Shall and will warrant and forever defend by these presents Upon trust nevertheless that the said Spencer R. Jenkins his heirs &C. shall permit the said Negro girl Cassell hereby conveyed and have the profit to his own use untill default be made in the payment of the Said sum of three hundred and Seven dollars and twenty five cents either in the whole or in part and then upon this further Trust that he the said Spencer R. Jenkins or his heirs Executors adm'r or assigns shall and will So Soon after the happening of Such default of payment as they or any or either of them may think proper or the said Simon Boykin his heirs Executors adm'r or assigns shall request sell the Said Negro girl Cassell and her increase if any to the highest bidder for redy money at publick Auction after having fixed the time and place of sale at their own discretion and given ten days notice thereof by advertising at the most publick places in the neighborhood and out of the monies arising from such sale after Satisfying the charges thereof and other [page break] [p.] 277 expences attending the said sale pay to the said Simon Boykin his heirs Executors administrators or assigns the said sum of three hundred and seven dollars and twenty five cents with the interest which may thereon lawfully have accrued, and the balance if any pay to Joseph Britt his heirs &c but_ if the whole of the said sum of three hundred and Seven dollars and twenty five cents and interest shall be paid off and discharged to the said Simon Boykin his heirs Ex'or &C. on or before the first day of January next when the same is payable & that no default of payment of three hundred and seven dollars and twenty five cents be made then this Indenture to be void or else to remain in full force & virtue In Witness whereof the Said parties to these presents have hereunto set their hands and affixed their Seals the day and date above written Signed Sealed & delivered his in presence of Saml. And in the clerks office the 15th day of October 1821 This Indenture was further proved by the oaths of Samuel Bridgers and Merit D. Stringfield the other two witnesses thereto and admitted to record And at a Court held for the County aforesaid of So'ampton the 19th day of November 1821 This Indenture as aforesaid was entered upon the proceedings of the day Teste James Rochelle CC Southampton Co., VA, Deed Book 18 (1821-22), pp. 275-77 The Library of Virginia (LVA), Richmond, VA, Southampton Microfilm Reel 8 Simon BOYKIN left will 15 Jan 1823, naming executors John URQUHART & John BOYKIN. John BOYKIN presented the will 19 Apr 1824, the writing proved by Silas SUMMERELL & Benjamin GRIFFIN, and Certificate for obtaining a probat was granted John BOYKIN, with Silas SUMMERELL & James B. URQUHART his Securities.
