JENKINS to John URQUHART Jr., for the benefit of John URQUHART Sr., deed of trust, 4 Negro slaves, 20 Sep 1821 (18 Feb 1822) [margin note] Jenkins to Urquhart Examined & delivered to Sam.G. Brittle Septr. 21st. 1822 This Indenture made and entered into this 20th. day of September in the year of our Lord One thousand eight hundred and twenty one Between Spencer R. Jenkins of the first part John Urquhart jr. of the second part and John Urquhart Senr. of the third part all of the county of Southampton and State of Virginia Witnesseth that the said Spencer R. Jenkins for and in consideration of the sum of Eight hundred and Eighty nine dollars and forty four cents which said Sum is due from the said Spencer R. Jenkins to the said John Urquhart Senr. by bond bearing date this 20th. day of Septr. one thousand eight hundred and twenty one as well as all other monies which may be due and owing from the said Spencer [page break] [p.] 365 R. Jenkins to the said John Urquhart Senr. by means of any dealings transfer of debts or papers whatever as also for and in consideration of one dollar to him in hand paid by the said John Urquhart jr. the receipt whereof the said Spencer R. Jenkins doth hereby acknowledge hath granted bargained and sold and by these presents doth hereby grant bargain and Sell convey and make over unto the said John Urquhart junr. and his heirs forever. all his right and interest in the following property to wit four negroes named as follows Vizt. Guinea Copeland Hollon and Peg belonging to him To have and to hold with all the right and interest of the said Spencer R. Jenkins the said Spencer R. Jenkins ^ herein conveyed or intended to be conveyed to him the said John Urquhart jr. his heirs and assigns forever upon this Special Trust nevertheless that the said John Urquhart jr. upon being thereto required by the aforesaid John Urquhart Senr. shall proceed to sell all the right and interest of the said Spencer R. Jenkins to the above named Negroes Guinea Copeland Hollon and Peg hereby conveyed or intended to be conveyed after advertising the time and place in the said County of Southampton for ten days previous at some publick House or store for cash and out of the money arising out or from the said sale in the first place pay and Satisfy all cost attend= Sale as well as the Expence attending the said ing the said ^ Conveyance and then pay off the Bond aforesaid with interest as well as all other monies which may ["be" struck] appear to be due and owing from the said Spencer R. Jenkins to the said John Urquhart Senr. by means of any dealings transfer of debts or paper whatever and the surplus if any pay to the said Spencer R. Jenkins and the said Spencer R. Jenkins for himself his heirs executors and. administrators the right and title of the said four Negroes unto the said John Urquhart. Jr. his heirs and assigns forever doth hereby warrant and defend against the Lawfull claim or claims of him the said Spencer R. Jenkins his heirs executors and adm'rs and against all and every other person or persons whomsoever. and the said John Urquhart jr. on his part covenants and agrees that he will make sale of the right and interest hereby conveyed for the best price he can obtain for the same after advertising the time and place for ten days previous at some publick house or Store in the said County and with the monies arising from the sale first pay and satisfy all cost attending the same as well as the expence attending this conveyance and then pay off the aforesaid Bond and interest as well as all other monies which may appear to the said John Urquhart jr. to be justly due and owing from the said Spencer R. Jenkins to the said John Urquhart Sr. by means of any dealings transfer of debts or paper whatever and then pay the overplus if any to the said Spencer R. Jenkins and the said John Urquhart jr. on [page break] [p.] 366 his part covenants and agrees that he will release the said four negroes from the obligation of this incumberance upon the said Spencer R. Jenkins paying him the amount of the aforesaid Bond with interest as well as other monies which may be due and owing to him from the said Spencer R. Jenkins by means of any dealings transfer of debts or paper whatever In witness whereof the parties to these presents have hereunto set their hands and seals the day and year first above written Signed sealed & delivered in presence of Spencer R.
