JENKINS to Merit M. ELEY, for the benefit of Thomas POND, deed of trust, 180 acres, 20 Feb 1822 (18 Mar 1822) [margin note] Jenkins to Pond This Indenture made and entered into this 20th. day of February in the year of our Lord One thousand eight hundred and twenty two Between Spencer R. Jenkins of the first part Thomas Pond of the second part and Merit M. Eley of the third part all of the County of Southampton and State of Virginia Witnesseth that the said Spencer R. Jenkins for and in consideration of the Sum of Two hundred forty four dollars and Eleven cents which said sum is due from the said Spencer R. Jenkins to the said Thomas Pond by means of any dealings bond bearing date the 20th. day of February. one thousand eight hundred and twenty Two as well as all other monies which may be due and owing from the said Spencer R. Jenkins to the said Thomas Pond by means of dealings transfer of debts or papers whatever as also for and in consideration of One dollar to him in hand paid by the said Merit M. Eley the receipt whereof the said ["Merit M. Eley" struck] Spencer R. Jenkins doth hereby acknowledge [page break] [p.] 382 hath granted bargained and sold and by these presents doth hereby grant bargain and sell convey and make over unto the said Merit M. Eley and his heirs forever all his right and interest in the following property to wit One certain Tract or parcel of Land lying between the lands of John Urqu= hart Simon Boykin and the heirs of Henry Fulgham containing by estimation One hundred and Eighty acres be the Same more or less belonging to him the said Spencer R. Jenkins To have and to hold with all the right and interest of the said Tract of Land herein conveyed or intended to be conveyed to him the said Merit M. Eley his heirs and assigns forever. upon this Special Trust nevertheless that the said Merit M. Eley upon being thereto required by the aforesaid Thomas Pond shall proceed to sell all the right and interest of the said Tract of land to the above named Merit M. Eley hereby conveyed or intended to be conveyed after advertiseing the time and place in the said county of Southampton for ten days previous at some publick house or store for cash and out of the money arising out or from the said sale in the first place pay and Satisfy all cost attending the said sale as well as the expense attending the said Conveyance and then pay off the sum aforesaid with interest as well as all other monies which may appear to be due and owing from the said Spencer R. Jenkins to the said Thomas Pond by means of any dealings transfer of debts or paper whatever. and the surplus if any pay to the said Spencer R. Jenkins And the said Spencer R. Jenkins for himself his heirs executors and administrators the right and title of the said tract or parcel of land unto the said Merit M. Eley his heirs and assigns forever doth hereby warrant and defend against the lawfull claim or claims of him the said Spencer R. Jenkins his heirs executors and administrators and against all and every other person or persons whomsoever and the said Merit M. Eley on his part covenants and agrees that he will make sale of the right and interest hereby conveyed for the best price he can obtain for the same after advertising the time and place for ten days previous at Some publick house or store in the said county and with the monies arising from the sale first pay and satisfy all cost attending the Same as well as the expense attending this conveyance and then pay off the aforesaid Bond and interest as well as all other monies which may appear to the said Merit M. Eley to be justly due and owing from the said Spencer R. Jenkins to the said Thomas Pond by means of any dealings transfer of debts or paper whatever and then pay the overplus if any to the said Spencer R. Jenkins and the said Thomas Pond on his part covenants and agrees that he will release the said Spencer R. Jenkins from the obligation of this incumberance upon the said Spencer R. Jenkins by Means of any dealings transfer of debts or paper whatever. Elley two of the witnesses thereto and continued for further proof And In the clerks office the 12th. day of March 1822 This Indenture was proved by the oath of Leml.B. Summ= erell the other witness thereto and admitted to record And at a Court held for the aforesaid County of Southampton on the 18th. day of March 1822 This Indenture as aforesaid was entered upon the proceedings of the day Teste James Rochelle c Southampton Co., VA, Deed Book 18 (1821-22), pp. 381-83 The Library of Virginia (LVA), Richmond, VA, Southampton Microfilm Reel 8 Trustee Merit M. ELEY conveyed this tract to Thomas POND, 2 Jan 1823, for $300.
