All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Southampton County Virginia USGenWeb Archives Land Records Samuel WHITFIELD & wife Elizabeth DREW WHITFIELD and George WILSON & wife Mary "Polly" DREW WILSON to Mills ELEY, deed of bargain & sale, 753 acres, 21 Jun 1822 (15 Jul 1822) [margin note] Wilson &wife to Eley Whereas Samuel Whitfield and Elizabeth his wife and George Wilson by a certain deed of bargain and Sale bearing date the tenth day of June one thousand eight hundred and Seventeen Sold and Conveyed as far as they Could then Convey as far as they Could certain Mills Eley for and in consideration of three thousand dollars therein expressed to have been paid to the Said Whitfield and Wilson a certain tract or parcel of land lying and being in the said county of Southampton Known by the name of William Boykins quarter on the main road leading from the Middle to the lower Seacock bridge it being the balance of the said quarter plantation after taking off the lower end Called Wrights place which said land the late William Boykin gave to his Granddaugh= ters Elizabeth and Mary Drews who have since intermarried with the said Samuel Whitfield and George Wilson which said land Contains by estimation (agreeable to the commissioners report who were appointed by the County Court of Isleofwight to divide the land belonging to the estate of the said William Boykin) Seven hundred and fifty three acres and bounded as described in the deed aforesaid and Whereas at the time of the execution of the deed aforesaid by the said Saml. Whitfield and Elizabeth his wife and George Wilson the said Mary Wilson formerly Mary Drew now the wife of the Said George Wilson was an infant under the age of twenty one Years by reason whereof her relinquish= ment of interest Could not be taken in the land aforesaid and hath not Yet taken and whereas also the Said George Wilson & Mary his wife are now anxious to make good the title to the said land to the Said Mills Eley by a deed to be executed by them to him and by having her relinquishment of interest taken according to Law Now. This Indenture made and entered into this 21st. day of June one thousand eight hundred and twenty two between the said George Wilson and Mary Wilson his wife and Mills Eley are parties to the deed made as aforesaid on the tenth day of June 1817 Witnesseth that the the said George Wilson and Mary his wife for and in consideration of the premises aforesaid and in consideration of the Said George Wilson having Recd. or having had received to him his proportion [page break] [p.] 488 of the sum of three thousand dollars mentioned in the deed herein before alluded to they the said George Wilson and Mary Wilson his wife have bargained and Sold and by these presents do grant bargain Sell and Convey unto the said Mills Eley his heirs and assigns their right and interest and title to a certain tract or parcel of land lying and being in the County of Southampton Know= n by the name of William Boykins quarter on the main road leading from the middle to the lower Seacock bridge which said land the said William Boykin gave to his grandaughters Elizabeth and Mary Drew Containing by estimation Seven hundred and ffity three acres be the same more or less which said tract of land is bounded in the following manner towit by the lands of Robert Hart Benjamin Crumpler and Thomas Turner on the east by the land above mentioned Called Wrights place on the South by the main run of Seacock Swamp thence up the main run of said Swamp to Jesse lowes line thence along the said Lowes line to the main run of the said Swamp to the mouth of Terrapin Branch in Majr. Simon Boykins line thence up the main run of the said branch near the main road thence across ["to" struck] the said road to the beginning together with all and Singular the appurtanances thereunto belonging and the reversion and reversions remainder and remainders issues and profits thereof and of every part and parcel To have and to hold the land hereby intended to be conveyed with the tenements hereditaments and all and Singular other the premises herein before mentioned to be bargained and Sold and of every part and parcel thereof with all their rights members and. appurtanances unto the Said Mills Eley his heirs and assigns forever and the said George Wilson and Mary his wife for themselves and their heirs the Said land herein intended to be bargained Sold and Conveyed unto the Said Mills Eley his heirs and assigns free from the claim or Claims of them the said George Wilson and Mary his wife or either of them their or either of their heirs and of all and every person whomsoever shall will and do warrant and forever defend by these presents ~ In Testimony Whereof the Said George Wilson and Mary his wife have hereunto Set their hands and Seals this day and Year aforesaid toWit the twenty first day of June in the Year one thousand eight hundred and twenty two Signed Sealed ackd. & } Geo. Isleofwight County Towit We Benjamin Drew and Edmund Pedin Justices of the peace in the County aforesaid in the State of virginia do hereby certify that Mary Wilson wife of George Wilson parties to a certain deed for the convey= ance of real estate to Mills Eley in the County of Southampton bearing date the 21st. day of June 1822 and hereunto annexed personally app= eared before us in our County aforesaid and being examined by us privily and apart from her husband and having the deed aforesaid fully explained to her she the said Mary Wilson acknowledged the same to be her act and deed and declared that she had willingly Signed Sealed & delivered the same and that she wished not to retract it_ Given under our hands and Seals this 21 June 1822 B. ĪsealĪ [page break] [p.] 489 Isleofwight County towit We Benjamin Drew and Edmund Pedin Justices of the peace in the County of Isleofwight do hereby certify that George Wilson and Mary his wife parties to a certain deed bearing date on the 21st. day of June one thousand eight hundred and twenty two and hereto annexed personally appeared before us in our County aforesaid and acknowledged the Same to be their act & deed and desired us to certify the Said acknowledgement to the Clerk of the County Court of Southampton in order that the Said deed may be recorded Given under our hands and Seals this 21st. day of June 1822 B. Drew ĪSealĪ Southampton County Edmund Pedin ĪSealĪ In the Clerks office the 4th. day of July 1822 This Indenture came to hand and together with the Certificate thereon endorsed certifying the acknowledgement of George Wilson and the acknowledgement & privy examination of Mary Wilson parties hereto and admitted to record And at a Court held for the aforesaid County of Southampton on the 15th July 1822 This Indenture and certificates as aforesaid were entered upon the procee= dings of the day Teste James Rochelle c // Southampton Co., VA, Deed Book 18 (1821-22), pp. 487-89 The Library of Virginia (LVA), Richmond, VA, Southampton Microfilm Reel 8 The original deed (DB15:352-54) mentioned above, executed 10 Jun 1817, is posted at: http://files.usgwarchives.net/va/southampton/deeds/15db352.txt The grantees also executed another deed (DB15:302-04) the same day, to Robert ADAMS of Nansemond Co., conveying the adjoining 180-acre WRIGHT tract mentioned above. That deed must also have been defective, but no similar acknowledgement appears in the Southampton Co. records.
