Witnesseth that whereas the said James Mountford stands justly indebted by a Note of hand to the said James Scott in the sum of one hundred and five dollars current money of the United States of America And whereas the further assura= nce of the payment it is agreed by the parties hereto that a conveyance in trust shall be made to the said John Moore for the benif= it of the said James Scott if the sum on the Note of hand aforesaid shall not be punctually paid with Lawfull interest thereon on or before the 1.st day of June next. Now this Indenture witnesseth that the said James Mountford for and in consideration of the premises and for the further sum of one dollar to him in hand paid the receipt of which is acknowledged hath bargained and sold and by these presents doth for himself his heirs Ex'rs and administrators give grant bargain and sell unto the said John Moore his heirs and assigns all the plantation tract or parcel of Land where the said James Mountford now lives which he bought of Charles Bryant and Temperance his wife, Containing by estimation one hundred and twenty one acres be the same more or less bounded by the known and reputed bounds thereof and also all the buildings woods waters advanta+ =ges and appurtenances to the same in any wise belonging and the reversions remainders rents issues and profits thereof and all the Estate right title of him the said James Mountford of in and to the same also one horse one cart and wheels three feather beds and furniture two chest. two tables To have and to hold the above granted and bargained premises with every of the appurtenances unto the said John Moore his heirs and assigns in trust forever And it is hereby declared to be the true intent and meaning of these presents that if the said James Mountford shall punctually pay unto the said James Scott his heirs or assigns the said sum of one hundred and five dollars and interest agreeable to the term of the said note of hand to the said James Scott then the said John Moore his heirs and assigns shall hold the said Land goods and chattles above granted to the sole and proper use and behoof of the said James Mountford and the said John Moore covenants and agrees with the parties hereto that if the said James Mountford his heirs Ex'ors and adm'rs shall fail to make payment to the said James Scott his heirs and assigns on or before the first day of June next the sum due on the note of hand aforesaid that then the said John Moore his heirs & assigns shall stand seized of the above granted and bargained premises for the purposes following that is to say that at the request of the said James Scott his heirs Exors. and admrs. or assigns he the said John Moore his heirs Ex'rs adm'rs or assigns or either of them shall give ten days notice and sell at publick sale the above mentioned tract of Land goods and chattles and shall pay the money arising therefrom to the said James Scott his heirs Ex'ors adm'rs or assigns so far forth as shall be then due and after satisfying the said Note of hand interest and all expenses arising or remaining from the said Notice and sale shall pay the surplus money to the said James Mountford or his assigns In witness whereof the parties have hereunto set their hands and seals the day and Year first above written signed sealed and delivered in presence of us James Mountford ĪsealĪ Wm.
