ELEY, trustee, to Thomas POND, deed of bargain & sale, 180 acres, 2 Jan 1823 (16 Jun 1823) [margin note] Eley as trustee to Pond This Indenture made this 2nd. day of January in the year of our Lord Eighteen hundred &twenty three Between Merit M. Eley Trustee to a certain deed of Trust executed to him by Spencer R. Jenkins to secure the payment of a certain sum of money to Thomas Pond of the County of Southampton of the one part Thom_ as Pond of Southampton County of the other part Witnesseth that the said Merit M. Eley &C. for and in con_ sideration of the sum of three hundred dollars lawfull money of Virginia to him in hand paid by the said Thomas Pond at or before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged have bargain_ ed and sold and by these presents do bargain and sell unto the said Thomas Pond his heirs and assigns forever all the right title and interest as trustee &C. as. above mentioned to a certain tract of Land in the County of Southampton whereon the said Spencer R. Jenkins now lives Containing by estimation one hundred and Eighty acres be the same more or less and bounded in the following manner toWit by the Land of Majr. Simon Boykin by the Land of John Urquhart by the Land called Fulghams and by Black water River tog= ether with all and Singular the appurtenances thereunto belonging and the reversion and reversions remainder and remainders yearly and other rents Issues and profits thereof and every part and parcel thereof To have & to hold the said Land with the tnements hereditaments and all and Singular other the premises herein before mentioned or intended to be bargained and Sold every part and parcel thereof with every of their rights members and appurtenances unto the said Thomas Pond his heirs and assigns forever. and the said Merit M. Eley Trustee &C. for himself and his heirs the said Land with all and Singular the premises & appur= =tanances as before mentioned unto the said Thomas Pond his heirs and assigns free from the claim or claims of him the said Merit M. Eley as trustee &C. his heirs and assigns forever and against all and every person or persons whatsoever. claiming by through or from him as Trustee Shall will and do warrant and forever defend by these presents In Witness whereof the said Merit M. Eley Trustee &c. has hereunto set his hand & seal the day and year first above written Merit M. JENKINS, indebted to Thomas POND, executed a deed of trust on this tract to trustee Merit M. ELEY, for the benefit of Thomas POND, 20 Feb 1822.
