All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Southampton County Virginia USGenWeb Archives Land Records Thomas POND, to trustee John DAVIS, for the benefit of Kinchen & Burwell WILLIAMS, deed of trust, 180 acres, 3 Apr 1827 (21 May 1827) [margin note] Pond to Davis Examined & Deliv= =ered to Burwell Williams Jany. 30th. 1828 This Indenture made and entered into this 3d. day of Apl. in the year of our Lord one Thousand eight hundred and twenty seven between Thomas Pond of the first part Kinchen Williams & Burwell Williams of the second part and John Davis of the third part all of the county of Southampton and State of Virginia. Witnesseth that the said Thomas Pond for and in consideration of the sum of five hundred dollars which sum is due from the said Thomas Pond to the said Kinchen and Burwell Williams by bond bearing date the third day of April 1827 as well as all other monies which may be due and owing from the said Thomas Pond to the said Kinchen and Burwell Williams by means of any dealings transfers of debt or paper as well as also for and in consideration of the sum of one dollar to him in hand paid by the said John Davis the receipt whereof the said Thomas Pond doth hereby acknowledge he hath granted bargained and Sold and by these presents doth grant bargain and sell Convey and make over unto the said Kinchen and Burwell Williams and their heirs forever all my right and interest in the following property to Wit ) one certain Tract or parcel of land lying on Black Water & being the land bought of Spencer R. Jenkins bounded by the land of John Urquhart and John Boykin belonging to the said Thomas Pond. To have and to hold with all the right and interest of the said Thomas Pond herein conveyed or intended to be conveyed to his the said John Davis his heirs and assigns [page break] [p.] 241 upon this special Trust nevertheless that the said John Davis upon being thereto requested by the aforesaid Kinchen and Burwell Williams shall proceed [to sell] all the right and interest of the said Thomas Pond to the above named property hereby conveyed or intended to be conveyed after advertising the time and place in the said County of Southampton for ten days previous at some public house or store for Cash and out or from the money arising from the Said Sale as well the expense attending the said conveyeance and then pay off the aforesaid summ with interest as well as all other monies which may appear to be due and owing from the said Thomas Pond to the said Kinchen & Burwell Williams by reason of any dealings transfer of any debt or paper whatsoever and the surplus if any pay to the said Thomas Pond and the said Thomas Pond for himself his heirs Ex'ors & adm'rs the right and title of the said Thomas Pond unto the said Kinchen & Burwell Williams And to their heirs forever doth hereby warrant and defend against the lawful claim or claims of the said Thomas Pond his heirs exors. and admrs. and against all and every other person whatsoever And the said John Davis on his part covenants and agrees that he will make sale of the right and interest hereby conveyed for the best price he can obtain for the same after advertising the time and place for ten days previous at some public house or store in the said County And with the money arising from the said sale first pay and satisfy all cost attending the same as well as the expense attending this conveyance and then pay off the aforesaid sum of five hundred Dollars and interest as well as all other monies which may appear to the said John Davis to be justly due and owing from the said Thomas Pond to the said Kinchen & Burwell Williams by means of any dealings transfer of debts or paper whatsoever And the pay the overplus if any to the said Thomas Pond and the said Kinchen & Burwell Williams on their part covenants and agrees that they will release the said Thomas Pond from the obligation of this incumbrance upon the said Thomas Pond paying them the Amt. of the aforesaid sum of Five hundred dollars with Interest as well as all other monies which may be due and owing to the said Kinchen and Burwell Williams by means of Any dealings transfer of debt or paper whatsoever In Witness whereof the parties to these presents have hereunto set their hands and seals the day and year above written Signed Sealed & delivered } Thos. And at a Court held for the County aforesaid the 21st. of May 1827 the said Indenture was recorded among the proceedings of the day Teste James Rochelle CC Southampton Co., VA, Deed Book 20 (1826-28), pp. 240-41 The Library of Virginia (LVA), Richmond, VA, Southampton Microfilm Reel 9 Spencer R. JENKINS, indebted to Thomas POND, executed a deed of trust on this tract to trustee Merit M. ELEY, for the benefit of Thomas POND, 20 Feb 1822.
