Branch Mathew_ Harriss & Eli Coker Commissioners appointed by order of the County Court of Southampton made at october Court one thousand eighteen_ hundred and thirty five to make sale of the Land whereon Polly Barnes died seized & possest_ of the one part. and Miles Scarborough of the County of Southampton of the other part: Witnesseth that for and in consideration of the sum of Seventy-three dollars current money of Virginia to the said Commissioners in hand paid or secured to be paid at or befor_ the ensealing and delivery of these presents, the re- ceit_ whereof is hereby acknowledged, they the said Lewis N. Branch Matthew Harriss & Eli Coker Commissioners as aforesaid, have granted bargained and sold and by these presents do grant bargain and sell unto the said Miles Scarborough his heirs and aS- signs. forever, one certain track_ or parcell_ of Land lying and being in the County _Coun- ty of Southampton containing by estimation one hundred and eighty acres, be the same, more or less, being the same track_ of Land whereon Polly Barnes decest_ formerly lived and bounded by the Lands of Burwell Barrett, John Hines and others with all and singular the premises and appurtenances thereunto belonging; to have and to hold the said track_ of Land and the appurtenances thereunto belonging unto him the sd. Miles Scarborough his heirs and assigns forever; & the said Lewis N. Branch Matthew Harriss and Eli Coker Commissioners as aforesaid do for the heirs of the said Polly Barnes and all and every other person or persons claiming by from or under them by vir- tue of the decree aforesaid the said track or parcell of Land with all and singu- lar the premises and appertenances befor_ mentioned unto the said Miles Scarborough his heirs and assigns free/ from the claim or claims of the heirs of the said Polly Bares_ or either of them, they or either of their heirs and of all and every person claiming by from or under the said Polly Barnes, warrant and forever defend (by virtue of there_ parts derived from the decree aforesaid. This Indenture was acknowledged by Lewis N. Branch and Eli Coker parties thereto, and, as to them admitted to record. [...] An Indenture of bargain & sale from James Clayton to William Raiford conveying all his right, title and interest in a tract of land formerly belonging to William Summerell decd. was acknowledged by said James Clayton before the Clerk in his office since the last Term and admitted to record: which is ordered to be inserted among the minutes of the proceed= ings of the day - [...] Sally Stephenson daughter of ___ West Robert West, James West & Jesse } West and Sally Britt Children of John West who was son of ___ } West, Sally West Talbert West and James West children of James } decd. who was son of ___ West Pltffs} In Chancery against } William West. Deft.} This day came the parties by their Counsel and the Commissioners appointed under the interlocutory Decre made in the Cause, October Court 1835, to make Sale of the Lands men- tioned, this day made the following Report, to wit, "December 12th 1835. In obedience to a decree made by the Worshipful Court of Southampton County Court, made October Court eighteen hundred and thirty=five, We, the Commissioners, have sold the said Tract of Land formerly belong- ing to Polly Barn, which she sd. Barns received of her father William West, by deed, and we the said Commissioners have made the reversion according to the deree_ Viz. one forth part pay- able to William West, one fourth part to Sally Stephens, one fourth part to Robert, James & Jesse and Martha Britt Children of John West, one fourth part to Sally Stephens, one fourth part to Henry West Tabert_ West and James West , Children of James West, decd. And having performed our respective duty we return to the Court. Given under our hands &c. Eli Coker. Lewis N. Branch. Matthew Harriss." Massenburg. In fairness, there was much happening- Littleton R. Edwards was elected Clerk of the Court, to replace the late James Rochelle, among other business, including criminal indictments.
