West 15 Jun 1838 This Indenture made this 16' day of May one thousand eight hundred and thirty seven between Solomon Britt & Martha M. his wife of the County of Southampton and State of Virginia of the first part, James C. West of the same County of the second part and James B. Urquhart of the County of Southampton and State of Virginia of the third part.: Witnesseth that Whereas the said Solomon Britt and Martha M. his wife Stands justly indebted by a note of hand to the said James C. West in the Sum of two hundred and ninety two dollars and Sixty five cents Current money of the United States of America, and whereas for the further assurance of the payment, it is agreed by the parties hereto that a Conveyance in trust Shall be made unto the said James B. Urquhart for the benefit of the said James C. West if the Sum on the note aforesaid Shall not be punctually paid with lawful interest thereon, on or before the first day of November next. Now this Indenture Witnesseth that the said Solomon Britt & Martha M. his wife for and in consideration of the premises and for the further sum of one dollar to him in hand paid the receipt whereof is acknowledged, hath bargained and Sold and by these Presents doth for himself his heirs, Executors and administrators, give, grant, bargain and Sell unto the said James B. Urquhart his heirs and assigns a Certain tract of land lying in the County aforesaid, it being the land Purchased of Burwell Williams, John H. Williams and Nicholas Williams, which formerly belonged to Spencer R. Jenkins Supposed to be two hundred acres more or less, and bounded as follows by the lands of John Urquhart, John Boykin and Black Water. To have and to hold the aforesaid granted Premises unto the said James B. Urquhart his heirs and assigns in trust forever. And it is hereby declared to be the true intent and meaning of these Presents that if the said Solomon Britt and Martha M. his wife Shall Punctually pay to the said James C. West his heirs and assigns the said Sum of two hundred and ninety two dollars Sixty five Cents and interest agreeable to the tenor of the said note to the said James C. West then the said James B. Urquhart his heirs and assigns shall hold the property above granted to the sole and Proper use & behalf of the said Solomon Britt and Martha M. his wife, and the said James B. Urquhart his heirs and assigns shall hold the property above granted to the sole and Proper use & behalf of the said Solomon Britt and Martha M. his Wife, and the said James B. Urquhart agrees with the parties hereto that if the said Solomon Britt his heirs Executors and administrators shall fail to make payment to the said James C. West his heirs or assigns on or before the first day of November next, the Sum due or the note aforesaid that then the said James B. Urquhart his heirs and assigns Shall Stand Seized of the above granted and bargained premises, for the purposes following, that is to say, that at the request of the said James C. West his heirs or assigns, the said James B. Urquhart his Heirs Executors, administrators & assigns or either of them shall give ten days notice and sell at public sale the above mentioned property and shall pay the money arising therefrom to the said James C. West his heirs or assigns so Fourth as shall be then due, and after Satisfying the said note, interest and all expences remaining or arising from the notice & Sale, shall pay the surplus money to the said Solomon Britt or his assigns_ In Witness whereof the parties have hereunto set their hands & Seals the day and year first and above written his Signed Sealed & delivered } Solomon X Britt ĪSealĪ in presence of } mark Martha M. West two of the parties thereto to be their act and deed and admitted to record And at a Court held for the County aforesaid on the 18th day of June 1837 the said Indenture was entered upon the Proceedings of the day. And in the said Office the 10th day of October 1837 the same was acknowledged by James B. Urquhart and admitted to record as to him Teste L.R. West against Solomon Britt. This day came the plaintiff, by his attorney, and it appearing to the satisfaction of the Court, that the defendant has had legal notice of the motion, he was solemnly called, but came not: Therefore it is considered by the Court that the plaintiff recover against the said Defendant, the sum of Four hundred and forty six dollars and thir [page break] [p.] 198 Teen cents with legal interest thereon from the 15th September 1834 till paid, also the sum of Thirty four dollars and fifty-one cents with legal interest thereon from the 19th day of August 1833 till paid, the amounts paid by the plaintiff to the administrators of Kinchen Williams decd. by vir- tue of two executions issued by them against the plaintiff upon Judgment founded on bonds in which the plaintiff was the defendant's security, And also that the plaintiff recover against the defendant his Cost. But this execution is to be credited with the sum of Two hundred and five dollars and six cents.
