Whereas the said Solloman Britt is justly indebted to the said James Atkinson in the sum of One hundred & nine dollars to be paid on the 5th day of October in the year of our Lord 1837 as my bond bearing date on the 18th day of August in the year 1837 more fully appears, which debt with the legal interest thereon accruing the said Solloman Britt is willing and desirous to secure. Now this Indenture witnesseth, that for and in consideration of the property and also for the further consideration of one dollar, of lawful money of Virginia, to the said Solloman Britt in hand paid by the said Bartholomew Bowers at & before the sealing & delivery of these presents, the receipt whereof is hereby acknowledged he the said Solloman Britt hath given, granted, bargained, sold, aliened, enfeoffed, released and confirmed & by these presents doth give grant, bargain, sell, alien, enfeoff, release, and confirm to the said Bartholomew Bowers his heirs & assigns forever all my personal estate to wit, three feather beds, one table four Chest, six winsor chairs, One Spinning wheel & kitching furniture, one Sorrel Mare, two cattle, One two-barrel still [page break] [p.] 128 two Sows, fifteen shoats, three weeding hoes three plough hoes, three Cutters, One hand saw, three augers one chisel & the present Crop of corn & fodder. To have and to hold the said property hereby conveyed, unto the said Bartholomew Bowers his heirs executors adm'rs and assigns for ever to only proper use and behoof of the said Bartholomew Bowers his heirs Extr. admrs. and assigns for ever. And the said Solloman Britt, for himself, his heirs executors & admrs. doth hereby covenant promise & agree, to & with the said Bartholomew Bowers his heirs Executors admrs. and assigns forever in manner & form following that is to say, that the said Solloman Britt, his heirs, executors & admrs. the aforesaid parcel of property hereby conveyed unto the said Bartholomew Bowers, his heirs, executors, admrs. and assigns against all persons where ever, shall and will warrant and forever defend by these presents, Upon trust nevertheless, that the said Bartholomew Bowers, his heirs executors & admrs. shall permit the said Solloman Britt to hold in quiet & peacea'le possession the aforesaid property here conveyed, and take the profits thereof to his own use untill default be made in the payment of the said One hundred & nine dollars either in whole or in part & then upon this further trust that he or the heirs, executors, admrs. or assigns of such trustee shall & will so soon after the happening of such default of payment as they or any or either of them, or the trustee or the heirs executors, admrs. or assigns of such trustee may think proper or the said James Atkinson, his executors, admrs. or assigns shall request sell the said personal property hereby conveyed or such part of the hereby granted property, as the trustee or their represntatives hereby authorised to act, shall think sufficient for the purpose and shall think proper to sell to the highest bidder for ready money at Publick auction after having fixed the time & place at his own discretion and given ten days' notice thereof, and also notified the same, by advertisement, to be set up at the door of the Court house of Southampton County, on some court day previous to the day of Sale and out of the money arising from such sale shall, after satisfying the charges thereof and all other expences attending, pay to the said James Atkinson his executors admrs. or assigns the said sum of One hundred & nine dollars with the interest which may thereon lawfully have accrued, and the balance, if any, shall pay to the said Solloman Britt, his heirs executors admrs. or assigns. But if the whole of the said Sum of one hundred & nine dollars with the interest shall be fully paid off & discharged to the said James Atkinson his executors admrs. or assigns on or before the 5th day of October in the year 1837 when the sum is payable so that no default of payment of the said sum of One [sic] default of payment of the said sum of one hundred & nine dollars with the interest be made then this Indenture to be void or else to remain in full force and virtue. This Indenture was proved by the oath of John P. Boykin a witness thereto, and, having been proved in said office on the 23rd of same month by the oath of Samuel H. Holmes & Goodman Horn, also Witnesses thereto, was admitted to record And at a court held for the said County on the 18th day of September 1837 the said Indenture was entered upon the proceedings of the day.
