DRAKE, Deed of Bargain & Sale, 19 Dec 1840 [margin notes] Drake to Drake Ex.d This Indenture made this 19.th day of December 1840 between Matthew Drake and Maria his wife of the County of Southampton of the One part and Thomas H Drake of the County of Nansemond of the other part: Witnesseth that the said Matthew Drake and Maria his wife for and in Consideration of the just and full sum of three hundred and fifty dollars Current Money of Virginia in hand paid by the said Thomas H Drake the receipt whereof is hereby acknowledged and the said Matthew Drake and Maria his wife have given granted bargained and sold and by these presents do give grant bargain and sell unto the said Thomas H DRAKE his heirs and assigns forever all that tract or parcel of Land which the said Matthew Drake purchased of Elijah Joyner Called the Oberry tract containing eighty acres more or Less [illegible] [page break] friend s.d Elijah Joyner and wife to said Matthew Drake together with all houses edifices buildings yards gardens orchards ways waters and watercourses whatsoever belonging or in any wise appertaining. To have and to _ [sic] the said tract of Land to him the said Thomas H Drake to him and his heirs forever and the said Matthew Drake and Maria his wife for themselves and their heirs doth warrant and forever defend by these presents against the claim or claims of every persons [sic] or persons claiming by or through them. Edwards C.C. Southampton Co., VA, Deed Book 25 (1840-1843), pp. 8-9 The Library of Virginia, Southampton Co. Microfilm Reel 11 [Matthew, James & Thomas H. were sons of Archibald & Polly (Williams) Drake. Matthew's wife Maria didn't sign this deed, nor did she relinquish dower.
