GOULD This Indenture made and entered into this 12.th day of December in the year of our Lord, one thousand eight hundred and forty two, between Johnson RAIFORD and Emily his wife of the first part, Charles G. GOULD of the second part and William RAIFORD of the third part, all of the County of Southampton and State of Virginia; Witnesseth, that the [altered from "for"] Said Johnson RAIFORD and Emily his wife for and in consideration of the sum of One hundred & five dollars and sixty eight Cents, which Said Sum is due from the said Johnson RAIFORD to the said William RAIFORD by bond bearing date the 12.th day of December one thousand eight hundred and forty two as well as all other monies which may be due and owing from the said Johnson RAIFORD to the said William RAIFORD by means of any [underlined] dealings, transfers of debts or paper whatsoever, as also for and in Consideration of one dollar to them in hand paid by the Said Charles G. GOULD, the receipt whereof the said Johnson RAIFORD and Emily his wife doth hereby acknowledge, hath granted bargained and Sold, and by these presents doth hereby grant, bargain and Sell, Convey & make over unto the Said C.G. GOULD and his heirs forever, all there [sic] rights and interest in the following property to wit: the land whereon Robert RAIFORD, Phillip RAIFORD, Shadrach JOHNSON and Lemuel RAIFORD now live Called the JOHNSON Tract of Land, Say forty acres more or less and bounded by the lands of James CLAYTON, Goodwin BRADSHAW, Mordecai BRADSHAW and the heirs of the BENNETs, his [altered from "this"] f๋the Beds & furniture, belonging to them the said Johnson RAIFORD and Emily his wife, herein conveyed, or intended to be conveyed, to him the said Cha.s G. GOULD his heirs and assigns forever. Upon this Special Trust nevertheless, that the said Cha.s G. GOULD upon being thereto required by the aforesaid William RAIFORD shall proceed to sell all the rights and interest of the Said Johnson RAIFORD and Emily his wife to the above named land and property hereby conveyed, or intended to be conveyed, after advertising the time and place in the said County of Southampton, for ten days previous at Some publick place for Cash; and out of the money arising out or from the said Sale, in the first place, pay and Satisfy all cost attending the Said Sale as well as the expenses attending the Said Conveyances, and then payoff the bond aforesaid with interest, as well as all other money's which may appear to be due and owing from the Said Johnson RAIFORD to the said William RAIFORD by means of any dealings, transfer of debts or paper whatsoever, and the surplus if any pay to the said Johnson RAIFORD, and the said Johnson RAIFORD & Emily his wife for themselves their heirs executors & administrators, the right and title of the said land and property herein conveyed to the Said Cha.s G. GOULD his heirs or assigns forever, doth hereby warrant and defend against the lawful claim or claims of them the said Johnson RAIFORD and Emily his wife their heirs Executors and administrators, and against all and every other person or persons whatsoever; and the Said Cha.s G. GOULD on his part covenants and agrees that he will make Sale of the right and interest hereby conveyed for the best price he can obtain for the Same after advertising the time and place for Ten days previous, at Some publick place in the said County and with the monies arising from the Sale first pay and Satisfy all costs attending the Same, as well as the expenses attending this conveyance and then pay off the aforesaid bond and interest as well as all other monies which may appear to the Said William RAIFORD to be justly [page break] [p.] 491 due and owing from the Said Johnson RAIFORD to the Said William RAIFORD by means of any dealings, Transfer of debts or paper whatsoever, and then pay the overplus if any to the Said Johnson RAIFORD, and the said C.G. GOULD on his part covenants and agrees, that he will release the Said Johnson RAIFORD and Emily his wife from the obligation of this incumberance upon the said Johnson RAIFORD paying him the amount of the aforesaid bond with interest as well as all other monies which may be due and owing to him from the said Johnson RAIFORD by means of any dealings, transfers of debts or papers whatsoever.
