HARRIS [brackets, line breaks & surname capitalization mine] Southampton Co., VA, Deed Book 26 (1843-1847), pp. 172-73 19 Feb 1844 Jeremiah SPIVEY to Shugars LAINE, for Mary LOWE Deed of Trust [margin notes] SPIVEY To- LOWs trustee Exam.d sent to Mary LOW - March 4/1845 This Indenture Made this 19.th day of Feby 1844, between Jeremiah SPIVEY the debtor of the 1st part and Shugars LAINE the trustee of the second part and Mary LOW the Creditor of the third part all of the County of Southampton and State of V.a. Whereas the said Jeremiah SPIVEY is Justly indebted to the said Mary LOWE in the sum of one hundred & fifty dollars good and lawful Money of V.a as by bond bearing date the 17.th day of Feby More fully appears which debt with the legal interest thereon accruing the said Jeremiah SPIVEY is willing & desirous to secure Now This Indenture Witnesseth that for an in Consideration of the premises and also for the further Consideration of one dollar to the s.d Jeremiah SPIVY the debtor in hand paid by the trustee at and before the sealing and delivery of these presents the Receipt whereof is hereby acknowledged he the said Jeremiah SPIVEY hath given granted bargained and Sold & by these presents doth give grant bargain and sell to the said Shugars LAINE his heirs and assigns forever All My interest in the Thirty acres of land also three beds & furniture ½ Dozen chairs one spinning wheel three chests one writing desk Two tables one Loom one shot gun one cart & wheels one pair andirons Tongs & Shovel one case & bottles one pot & oven Two cows Eight head of hogs Crop of Corn & fodder & Carpenters tools To have and to hold the aforesaid Named property unto the ['said'] Shugars LAINE his heirs Exrs admrs & assigns forever, to the only use and behoof of him the said Shugars LAINE his heirs Exrs admrs & assigns forever and the said Jeremiah SPIVEY for himself his heirs Exrs admrs doth hereby covenant promise and agree to and with the said Shugars LAINE his heirs Executors admrs and assigns forever in Manner & form following, that is to say the ['said'] Jeremiah SPIVY his heirs Exrs and admrs the aforesaid Named property hereby Conveyed unto the said Shugars LAINE, his heirs &c against all persons whatsoever shall and will warrant and forever defend by these presents upon Trust Nevertheless that the s.d Shugars LAINE his heirs Exrs admrs Shall permit the said Jeremiah SPIVEY to remain in quiet and peacable possession of the aforesaid Named property until default be Made in the payment of the sum of one hundred & fifty Dollars Either in whole or in part and upon this further Trust that they or any two or Either of them or the Survivor of them or the heirs Exrs admrs or assigns of such survivor shall and will so soon after the hapening of default of payment is made The s.d Mary LOW her heirs Exrs or assigns May think proper shall request the sale of the afores.d property or such a part thereof as the trustee shall think sufficient to satisfy the above Claim and think proper to sell to the highest bidder for ready Money: at public auction, after having fixed the time and place of sale at his own discretion and given ten days Notice thereof and also Notifyed the same by advertisment to be set up at the door of the Courthouse of Southampton County on some Court day previous to the day of Sale [page break] [p.] 173 And out of the Monies arising from such sale shall after Satisfying the Charges thereof and all other Expenses attending the premises pay to the s.d Mary LOW her heirs Exrs admrs or assigns the said sum of one hundred and fifty dollars with interest thereon and the balance if any Shall pay to the said Jeremiah SPIVEY his heirs Exrs admrs or assigns, but if the whole of the aforesaid debt is fully paid off and discharged to the s.d Mary LOW. her heirs Exrs: &c so that No default of payment of the aforesaid debt be Made then this indenture to be void or else to remain in full force and virtue In Witness whereof the parties to these presents have hereunto Set our hands & affixed our seals the day and year first written Jeremiah SPIVEY *seal* Shugars LAINE *seal* Signed Sealed and delivered} in presence of [blank- witnesses not given] Southampton County in the Clerks office the 19.th day of February 1844- This Deed of Trust between Jeremiah SPIVEY of the first part Shugars LAINE of the second part & Mary LOW of the third part was acknowledged by the SPIVEY & LAINE two of the parties thereto and admitted to Record Teste L.R.
