June, 1845 Between James Cook of the one part and Nancy Mercer of the other both of Southampton County, Whereas the said James Cook and Nancy Mercer have agrred to solemnize Matrimony between themselves, and be lawfully Man & wife But do covenant and agree with each other on the following terms: The said Jas. Cook and Nancy Mercer is to retain all the property which she the said Nancy Mercer is now in Possession The Plantation whereon she lives one house the stock of cattle hogs & sheep [page break] [in modern pen, p.] 405 household & kitchen furniture plantation utencils &c and all her property of every descrip =tion including the growing crop of all kinds corn &c, But at the death of the said Nancy Mercer who will then be Nancy Cook she gives all the above Named property to her foure_ daughters. Namely Martha Mary Emeline & Louisa Mercer to them and their heirs forever & they the said N. Mercer & James Cook doth further agree that None of the property which she is Now in possession shall Not be subject to the payments of any debts he has contracted heretofore or hereafter but to remain in quiet possession of them both until the death of the said N. Edwards m. 8 Jul 1845, on Tuesday morning, by Baptist min. Samuel H. Holmes (M.Reg. 1750-1853, pp. 546,723) John MERCER died in 1840.
