POPE, deed of bargain & sale, 51¼ acres, 13 Mar 1846 (16 Mar 1846) [margin notes] Barnes & al To Myrick delivered to Th.o Worrell Know all Men by these presents that whereas James E. Drake of the County of Sounthampton did convey by deed of Trust to William Myrick of the same County unto this property: the certain tracts or parcels of land lying in the County aforesaid for the purpose of securing the payment of two hundred and one dollar and seven cents due to Jacob Barnes also one hundred and twenty six dollars and eighty Nine cents due to Benj.a E. & Harrison P. Pope and whereas by the consent of us the undersigned and at our request the said James E. Drake and William E. Myrick trustee and the said James E. Drake's wife of her own accord have sold fifty one and one fourth acres of one of the tracts of land conveyed in the deed of trust aforesaid to Bennett Barrett of the said County the boundaries of which will appear in the deed following for the Sum of one hundred and fifteen dollars and thirty one cents which sum is applied in part payment of the debt due to said Benj:a E. & Harrison P. Pope the receipt of which we Benj.a E. & Harrison P. Pope hereby acknowledge, and to which I Jacob Barnes consent In Consideration of the said Sum of one hundred and fifteen dollars 31/100 paid by the said James E. Drake through said Bennett Barrett to said Benj.a E. & Harrison P. Pope we Jacob Barnes & Harrison P. Pope do hereby fully authorize the said William E. Myrick as aforesaid to convey by deed to said Bennett Barrett in conjunction with James E. Drake & wife all right, title & interest in the said fifty one & one fourth acres land as described in the following deed which was vested in him and his heirs by the deed of Trust aforesaid. Drake and Susan his wife and William E. Myrick trustee to a deed of Trust executed to him by said James E. Drake bearing date on the 13" day of March 1846 to secure the payment of certain debts due to Jacob Barnes and Benj.a E. & Harrison P. Pope and duly recorded in the Clerks office of Southampton County all of the said County of Southampton and State of Virginia of the one part and Bennett Barrett of the said County and State of the other part: Witnesseth taht the said James E. Drake and Susan his wife for and in consideration of the sum of one hundred and fifteen dollars and thirty one cents to them in [page break] [p. 523] [margin notes] delivered to Tho.s B. Worrell hand paid by the said Bennett Barrett at the sealing and delivery of these presents the receipt whereof is hereby acknowledged: have granted bargained and sold and by these presents do and each of them doth grant bargain and sell unto him the said Bennett Barrett his heirs and assigns forever one certain tract or parcel of land Situate lying and being in the aforesaid County of Southampton & parish of saint Lukes containing by a late survey Fifty one & one fourth acres (be the same More or less) it being part of the tract of land whereon the said James E. Drake Now resides and bounded as follows to wit- begining at a small pine standing in the line between said James E. Drake and said Bennett Barrett thence along a New line of Marked trees between them N355½ E109½ poles to the center of the fish road a New corner for said Drake & Barrett in William Drake's line thence along the road 155 poles to a corner for said William Drake & William Bryant and Jacob Barrett's estates thence along said Barrett's line S28 W12 poles to a pine stump a corner thence N67 W168 poles to a read oak a corner for said Bennett Barrett thence his line N75 W22 1/3 poles to the first station: To have and to Hold the above described tract or parcel of land and premises with all and singular the appurtenances thereto belonging or in any wise appertaining unto him the said Bennett Barrett his heirs and assigns forever to and for the only proper use and behoof of him the said Bennett Barrett his heirs and assigns forever and the said James E. Drake and Susan his wife for themselves their heirs Executors and admr.s do and each of them doth hereby covenant and agree to and with the said Bennett Barrett his heirs and assigns that they will by these presents warrant and forever defend all their right and title to the aforesaid tract or parcel of land against the claims or demands of all and every other person or persons whatsoever, and the saidWilliam E. Myrick trustee as aforesaid doth hereby convey to him the said Bennett Barrett his heirs and assigns all the right and title interest or estate of the above described tract or parcel of land which was vested in him by the above Mentioned deed of Trust, and will by these presents warrant and forever defend said vested right against himself and his heirs. In witness whereof the said James E. Drake & Suasan his wife and William E. Myrick have hereunto set their hands and affixed their seals the day and year first above written; James E. Drake, Two of the parties to the within deed bearing date on the 13' day of March 1846 personally appeared before us in our County aforesaid and being examined by us privily and apart from her husband and having the deed aforesaid fully explained to her, She the said Susan Drake acknowledged the same to be her act and deed and declared that she had willingly Signed Sealed and dellivered the same and that She wished not to retract it.
