URQUHART to James G. JONES, deed of bargain & sale, 20 acres, 26 Oct 1846 (9 Nov 1846) [margin note] Jones To [sic] Urquhart I James B. Urquhart Commissioner appointed by the County Court of Southampton at the October Term 1846 after giving due Notice thereof did cause to be put up to the highest bidder on Nine Months credit a certain tract of Land in the County of Southampton and State of Virginia belonging to the estate of the late Robert Mercer containing by estimation twenty acres be the same More or less and bounded by the Land of Catherine Johnson on the North on the east by the Land of William Bowden on the South & Southwest by the Land of William Herring and by the Land of James G. Jones on the North west James G. Jones bid Thirty Dollars, which was the highest bid and I James B. Urquhart Commissioner did bargain and Sell and do hereby transfer and convey to the said James G. Jones his heirs and assigns the above described Land for the consideration of the said James G. Jones executing a bond with good and Sufficient Security to Me as Commissioner Payable Nine Months after the 26th day of October 1846 for thirty dollars. To have and to Hold the same to the said James G. Jones his heirs and assigns forever I James B. Urquhart Commissioner do covenant to the said James G. Jones that I as Commissioner am lawfully Seized of said Land; have a good right to convey it & that the same is unincumbered I as Commissioner do further covenant and bind Myself My heirs and Representatives to warrant and forever defend the title to the said Land and every part thereof to the said James G. Jones against the lawful claims of all persons whatever As Witness My hand and seal the 26th day of October 1846 James B. Urquhart Comr. Jones was acknowledged by said Urquhart and admitted to Record Teste L.R. Edwards CC. Southampton Co., VA, Deed Book 26 (1843-47), p. 589 The Library of Virginia (LVA), Richmond, VA, Southampton Microfilm Reel 11 OB 1843-49:436-37,442 At a Court of monthly Sessions held for the County of Southampton at the Courthouse on the 19" day of October 1846. [...] Polly Mercer widow of Robert Mercer decd. relinquished her right to the administration on the estate of her deceased [husband] in favour of Anselm B. Urquhart, And thereupon on the motion of the said Anselm B. Urquhart who made oath and together with James B. Urquhart and Richard A. Urquhart his securities entered into and acknowledged a bond in the Penalty of One thousand dollars conditioned as the Law directs Certificate is granted him for obtaining letters of administration on the estate of Robert Mercer decd. in due form - Ordered that John Boykin. John Bowers. Joshua Presson and Arthur W. Holleman or any three of them, being first duly Sworn before a Justice of the Peace for the Purpose. do appraise all the Personal estate of Robert Mercer decd. and return the appraisement under their hands to the Court _ - [...] Polly Mercer Pltff.} against } In Chancery James Mercer & Mercer infant children of Robert } Mercer decd. by L.R. Edwards their guardian ad litem Defts.} This day this cause was docketed by consent of the parties with the assent of the Court came again to be heard on the bill and answer and was argued by Counsel. On consideration whereof the Court doth adjudge, order and decree that John Boykin, John Bowers, Joshua Presson and A.W. Holliman, any three of them who may act, lay off and assign by metes and bounds, one third part in value of all the lands of which Robert Mercer died, seized to Polly Merser to be held by her for life as dower in the lands of her deceased husband. And the Court doth further decree. that James B. Urquhart, who is appointed a Commissioner for that purpose, Sell the lands of which Robert Mercer died ,seized, not incumbered by deed of trust) to the highest bidder on a credit of twelve months, take bond and Security of the purchaser of the purchase money, make a deed to the purchaser_ and the said Commissioners are required to report their proceedings to Court in order to a final decree _ = [...] OB 1843-49:603,609 At a Court of Quarterly Sessions held for the County of Southampton at the Courthouse thereof on the 20" day of March 1848. Edwards } their guardian ad litem Defts.} The Commissioners in this cause this day made their report which is in these word to wit, "In Pursuance to the annexed decree the Commissioners Proceeded to lay off the dower of Polly Mercer, and James B. Urquhart sold the land by the decree on the Premises to the highest bidder at which sale James Jones became the Purchaser for the sum of thirty dollars Your Commrs. after Paying the expenses paid over the balance to Richard Urquhart the Ex'or of Jno. Urquhart All of which is respectfully Submitted _ Jno. Boykin, Jno. Bowers, Joshua Presson, A.W. Holleman, James B. Urquhart"- = [...] OB 1843-49:614-15 At a Court of Monthly Sessions held for the County of Southampton at the Courthouse thereof on the 17" day of April 1848.
