EDWARDS, for Edwards BUTTS Deed of Trust [margin note] Sent to J.T. BUTTS Exa. Snt This Indenture Made and entered into this the 1.st day of November 1847 between Madison LOWE of the one part Littleton R. EDWARDS of the second part and Edwards BUTTS of the third part: Witnesseth that the said Madison LOWE is indebted unto the said Edwards BUTTS in the sum of five hundred and ten dollars by Note bearing date even with these presents and being willing and desirous to Secure the payment thereof hath agreed to convey the property herein after Mentioned unto the said Littleton R. EDWARDS in Trust to be sold for that purpose: Now Therefore for and in Consideration of the premises as well as for the further consideration of one dollar to the said Madison LOWE by the said Littleton R. EDWARDS in hand paid the Receipt whereof is hereby acknowledged he the Said LOWE has granted bargained and Sold and by these presents does grant bargain and sell unto the said Littleton R. EDWARDS his heirs and assigns a certain tract or parcel of Land lying and being in County of Southampton State of Virginia and bounded by the lands of David DOYAL Richard KELLO Holladay WOOTEN and others and containing by estimation four hundred and forty five acres be the same More or less together with all and Singular the priviledges and appurtenances whatsoever to the said tract or parcel of Land belonging or in any wise appertaining: To have and to hold the said tract or parcel of Land and premises with its appurtenances unto him the said Littleton R. EDWARDS his heirs and assigns forever. Upon the following Trust and condition that if the said Madison LOWE shall fail to pay & discharge the debt above Mentioned due the said BUTTS and the costs of the Indenture on or before the 1.st day of January 1848 that it shall be lawful for the said Edwards BUTTS his Executors administrators or assigns to Make sale of the Tract of Land and premises herein before conveyed at public auction for cash, having fixed the time and place of sale at his own discretion and given reasonable public Notice thereof, and out of the Monies arising from such Sale and this Conveyance pay and Satisfy the debts hereon before Mentioned due the said BUTTS and the Surplus if any pay over to the said Madison LOWE his Executors or administrators.
