STEPHENSON & wife Elizabeth Deed of Partition [margin notes] RAIFORD with STEPHENSON } Partition This Indenture made and entered into this 29.th day of July A.D. 1852, between Robert RAIFORD and Mary A. his wife of the one part and William G. STEPHENSON and Elizabeth his wife of the other part, Whereas the said Robert RAIFORD and William G. STEPHENSON are jointly entitled in fee simple to a certain tract or parcel of land lying and being in the County of Southampton containing three hundred and forty acres more or less, being the land which descended to Lawrence LUTER & Robert RAIFORD in right of his wife by the death of Nathan LUTER dec.d And whereas the said Robert RAIFORD and William G. STEPHENSON have concluded to hold and enjoy their respective parts of the said tract or parcel of land in severally, and have mutually agreed and determined to make a partition of their rights therein So that each may have, hold and enjoy his property in severally, to him and his heirs and assigns forever; and for that purpose have divided the aforesaid tract or parcel of land so as to give to each the portion to which they are respectively entitled, that is to say, the said Robert RAIFORD two thirds, and the said William G. STEPHENSON, one third in value of the said tract or parcel of land, and it is hereby covenanted and agreed between the parties to these presents, that the said Robert RAIFORD his heirs and assigns shall henceforth have, hold, possess and enjoy in severally the portion of the aforesaid tract, or parcel of land described and bounded as follows: by the lands of Allen EDWARDS, William BABB, Matthew HARRIS, Samuel CORBITT, Levi TURNER, James CORBITT and Joseph JOHNSON, and containing three hundred acres more or less together with all the buildings and other improvements thereon and Shall pay to the said William G. STEPHENSON one hundred and twenty five dollars which with the portion, of land hereafter allotted to him will constitute his the said William G. STEPHENSON's full share or one third in value of the aforesaid tract of 340 acres of land. And that the said William G. STEPHENSON his heirs and assigns shall likewise henceforth have, hold, possess and enjoy in Severally that portion of the aforesaid tract or parcel of 340 acres of land known as the Old place, containing forty acres more or less and bounded as follows: by the lands of Joseph JOHNSON, James CORBITT, Wiley DUCK and Allen EDWARDS together ['with'] all the buildings and other improvements thereon which with the aforesaid Sum of one hundred and twenty five dollars paid him by the said Robert RAIFORD constitutes the said STEPHENSON's full share or one third in value of all the said lands. This Indenture therefore witnesseth that in consideration of the premises aforesaid and the sum of one hundred and twenty five dollars to the said William G. STEPHENSON paid, they the said W.m G. STEPHENSON and Elizabeth his wife do grant, release and confirm to the said Robert RAIFORD, his heirs and assigns forever the three hundred acres of land, so as aforesaid allotted to the said Robert RAIFORD as and for his full share, part and portion of and in the aforesaid tract orparcel of land of 340 acres. To have and to hold the same with all the priviledges and appurtenances thereto belonging to him the said Robert RAIFORD his heirs and assigns forever in severally as aforesaid and to his and their own use and behoof forever. And this Indenture further witnesseth that the said Robert RAIFORD and Mary A. his wife, do hereby also in consideration of the premises [page break] [p.] 302 aforesaid grant, release and confirm to the said William G. STEPHENSON, his heirs and assigns forever the forty acres of land so as aforesaid allotted to him which with the one hundred and twenty dollars paid him by the said RAIFORD (the receipt of which is hereby acknowledged) constitutes his the said STEPHENSON's full share, part or portion of and in the aforesaid tract or parcel of land. To have and to hold the same with all the priviledges and appurtenances thereto belonging to him the said William G. STEPHENSON his heirs and assigns forever in severally, and to his and their own use and behoof forever. SUMMERELL and Samuel B. KELLO justices of the peace for the County of Southampton in the State of Virginia, do certify that Mary A. the wife of Robert RAIFORD and Elizabeth the wife of William G. STEPHENSON whose names are signed to the writing above bearing date the 29.th day of July 1852, personally appeared before us in the County aforesaid and being examined by us privily and apart from their husbands and having the writing aforesaid fully explained to them they the said Mary A. RAIFORD and Elizabeth STEPHENSON acknowledged the said writing to be their act and declared that they had willingly executed the same and do not wish to retract it. SUMMERELL a justice of the peace for the County of Southampton in the State of Virginia, do certify that Mary A. RAIFORD and Elizabeth STEPHENSON whose names are Signed to the writing above bearing date the 29.th day of July 1852 have acknowledged the same before me in my County aforesaid. This deed of Partition between Robert RAIFORD & wife and W.m G. STEPHENSON & wife was acknowledged by the said RAIFORD & STEPHENSON and together with the certificates of the privy examination and acknowledgement of the said wives, admitted to record. Teste, L.R.
