Tyler, the Trustee ~ This Deed of Trust made this 29th. day of October 1858, between W'm.R. Parker of the one part and Thomas N. Briggs trustee of the other part, Witnesseth; that the said Wm.R. Parker doth convey unto the said Thomas N. Briggs trustee the following property, towit; One bay horse King, one Bay mare, Julia and her future [page break] [p.] 361 increase, one Buggy & harness; one Sulky & harness, one Cart & wheels, 2 Sows & 10 Shoats, 20 bls Corn & 4000 l'bs fodder all his household and Kitchen fur -niture, consisting of four feather beds & furniture, one Wardrobe, one side Board, one Bureau, one Marble top washstand, 2 Walnut Tables, one pine Table 2 Sofas, One Doz: Walnut chairs, 2 Marble Top Tables, Carpet in parlor, one Desk, one Book Case, one Doz common chairs, 2 Looking glasses, 2 Wash Stands, All his Crockery & Glass ware, one Double bbl. gun, also the lot and land whereon said Parker now resides containing by estimation Seven acres more or less, Also all debts due to said Wm.R. Parker either by Bond or open accounts In trust to secure first a Bond due by said Wm.R. Parker to Henry S. Howard Trustee for four hundred & Seventy nine Dollars & forty seven cents to which Jno.J. Kindred & Wm.W. Briggs are security _ Secondly a Bond due Jno.J. Kindred for about Three hundred & eighty eight Dollars & a Bond due Wm.W. Briggs for about Two hundred & fifty five Dollars. Witness the following Signatures and Seals. Wm.R. Parker ĪsealĪ ĪsealĪ Southampton County, In the Clerk's Office, November 1st 1858. This Deed of Trust was acknowledged by Wm.R. Parker, a party thereto, and was thereupon admitted to record. Teste, L.R. Edwards, C.C. [margin notes] 1871 Oct.Ct. W.B. Shands appointed trustee This Deed made this 5th. day of November A.D. 1858, between Wm.R. Parker of the one part and Henry S. Howard trustee of the other part, Witnesseth that the said Parker grantor doth grant and convey unto the said Howard, all that lot or parcel of land lying in or near the Town of Jerusalem in the County of Southampton, being the same lot whereon the said Parker now resides, supposed to contain Seven acres more or less and bounded by the lands belonging to the heirs of the late James Rochelle, of the late Fielding J. Mahone and by the Public road, together with all the buildings, privileges and appurtenances thereto attached. In trust to secure the payment of a bond executed by said W'm.R. Parker on the 12th. day of August 1858 payable on demand to Thomas N. Briggs for the sum of Eleven hundred & seventy eight dollars and a bond executed by said Wm.R. Parker on the 22nd. day of September 1858 and payable on demand to Richard J. Darden for the sum of nine hundred and Sixty two dollars & fifty one cents _ both of which bonds are now in suit in the Circuit Court of Southampton County. But it is expressly stipulated and agreed by all the parties hereto, that the said Wm.R. Parker shall remain in quiet and peaceable possession of the said lot or parcel of land hereby conveyed for the Space of three years from the date of these presents and have the exclusive use of the same for his own benefit during that time in the same manner as heretofore At the expiration of that period on the order of either the said Briggs or Darden or their legal repre- sentatives, the said lot or parcel of land may be sold (in case the Debt hereby secured are not paid) the expenses of this trust paid including five per cent commission to the trustee, the Debts or liabilities paid as herein directed, the balance, if any, pay over to the said said Wm.R. PARKER was a physician. Henry Shield HOWARD (d. 25 Feb 1869) was deputy clerk of Southampton Co. Court. His widow Josephine ran a hotel in Jerusalem. They are buried in Hollywood Cemetery, Newsoms. Southampton County Historical Society {SCHS} Cemetery Project, Hollywood list (N-41): http://files.usgwarchives.net/va/southampton/cemeteries/hollywd.txt Josephine relinquished her right to administer her husband's estate, 21 Jun 1869, & William B. SHANDS qualified as administrator. SHANDS brought suit against Dr. PARKER, heard 21 Feb 1870, the Court ruling that James R. TYLER replace the late Thomas N. BRIGGS as trustee. (Southampton Co., VA, Court Minute Book 1861-70, pp. 540, 614) Benjamin E. POPE, Harrison P. POPE & James J. DARDEN brought suit against SHANDS, heard 16 Oct 1871, the Court ruling that SHANDS replace the late Henry S. HOWARD as trustee.
