MAHONE to John Julius KINDRED, deed of bargain & sale, 60a., Jerusalem, 7 Oct 1859 (18 Oct 1859) [margin note] Ex'd & delivered to C.E. Knight for Mr. Howard This deed made this seventh day of October in the year one thousand eight hundred and fifty nine, between and Martha Mahone, Nancy J. Manry, William Mahone and wife Otelia, William W. Briggs and wife Susanna C. (Grantors) of the first part, and Jno.J. Kindred (Grantee) of the other part; Witnesseth; That the said grantors, for and in consideration of the sum of one thousand five hundred dollars to the said grantors by the said grantee paid, the receipt of which sum is hereby acknowledged do grant and convey to the said grantee that tract or parcel of land lying in and near Jerusalem Containing by estimation Sixty acres more or less it being the same which was owned by Fielding J. Mahone in his lifetime and is bounded by the lands lately owned by James Sebrell, those belonging to the estate of H.D. Moore, the county road &c. together with the dwelling house in which the said Martha Mahone now resides, the lot and garden thereto attached and all the buildings thereo. But half an acre of the said land whereon the said Grave yard is located, with the right of way ingress and egress to and from the same, at all times for any purpose of burial or inclosure. Also the office now occupied by W'm.B. Shands and the store house for- merly occupied by Richard H. Blythe with the right of way as now used to the upper story of the latter together with the land included by the respective inclosures to the said office and store house excepted. The Possession of the said is to be given by the said grantors to the said grantee the 25th. December next; but the possession of the said buildings hereby conveyed may be retained by the said grantors at their discretion till the first day of June next, but is to be accepted by the grantee if offered at any earlier day. And the said buildings are to be delivered in the same order and condition which they are now in except the impair- ment caused by natural decay. The said grantors, severally and jointly, individually and collectively covenant with said grantee that they will warrant generally the property hereby granted and conveyed. Duffield, a Notary Public for the Corporation of the City of Norfolk in the State of Virginia: do certify that Otelia B. Mahone, the wife of William whose names are Signed to the above writing bearing date on the 7th. day of October in the year 1859, personally appeared before me in the Corporation aforesaid and being examined by me privily and apart from her husband and having the writing aforesaid fully explained to her, the said Otelia B. Mahone acknowledged the said writing to be her act and declared that She had willingly executed the same and does not wish to retract it. Given under my hand this 17th. day of October 1859. C.B. Briggs, his wife, also a party thereto, appeared before me, Clerk, and on being examined privily and apart from her husband by me, and having the said deed or writing fully explained to her, she acknowledged the same to be her act and declared that She had executed it willingly and does not wish to retract it and the said Deed was proved as to Martha Mahone, Nancy J. Manry & William Mahone, other parties thereto, by the oaths of W'm.R. Parker & Thomas N. Briggs, the subscribing witnesses thereto and together with the certificate of the privy examination and acknowledgment of Otelia B. Mahone another party thereto, was admitted to record. Teste, L.R. HENDERSON, who in turn conveyed his purchase and personal property to William W. BRIGGS in a deed of trust, to secure his bond to KINDRED for the purchse price. MAHONE & wife Martha, and daughters Nancy & Susanna, are buried in the MAHONE-MANRY family cemetery, just off Linden St., Courtland - the ―a. "Grave yard" reserved in the deed. They are buried in Blandford Cemetery, Petersburg. William W. & Susanna (MAHONE) BRIGGS brought suit in Chancery Court (Case 1855-017), leading to the sale 1 Jan 1861 (ad. 18 Feb 1861) of another 16 & 2/3-acre tract to James HOLT, by Wm.W.
