(DAUGHTREY) KELLO to Bolivar T. HENDERSON, deed of bargain & sale, tavern, Jerusalem, 7 Nov 1859 Bolivar T. HENDERSON to Andrew J. KELLO, for Samuel KELLO, deed of trust, real & personal property, Jerusalem, 7 Nov 1859 This Deed made this 7th. day of November 1859, Between Samuel Kello & Mary A.R. his wife of the one part and Bolivar T. Henderson of the other part, Witnesseth; that in consideration of the sum of Two thousand Dollars the said Samuel Kello & Mary A.R. his wife, do grant unto the said Bolivar T. Henderson all their right, title & Interest in the Tavern lot and Lands & houses thereto belonging being the same that the said Kello purchased, which will fully be designated by reference to the decree under which the same was sold. Witness the following signatures and seals. Samuel Kello ĪSealĪ Mary A.R. Kello ĪSealĪ State of Virginia, County of So.ampton, to wit; We, Irvin Griffin & Robert M. Doles, Justices of the peace in the County & State aforesaid do certify that Mary A.R. Kello, the wife of Samuel Kello, whose names are signed to the writing above bearing date on the 7th. of November 1859, personally appeared before us in the County aforesaid and being examined by us privily & apart from her husband and having the writing aforesaid fully explained to her, she, the said Mary A.R. Kello acknowledged the said writing to be her act & declared that She had willingly executed the same & does not wish to retract it. Given under our hands this 7th. day of November 1859. This Deed of Bargain and sale was acknowledged by Samuel Kello, a party thereto, and together with the certificate of the privy examination and acknowledgment of Mary A.R. Kello also a party thereto, was admitted to record. Teste, L.R. Edwards, C.C. [margin notes] 1859 Dec 12 Origl. Examined & deld. trustee 1860 Decr. John Kello app. trustee This Deed 7th. day of November in the year 1859, Between Bolivar T. Henderson of the one part and Andrew J. Kello, trustee, of the other part, Witnesseth: that the said Boli =var T. Henderson doth grant unto Andrew J. Kello, trustee, the following property, the Tavern Lot & lands & Houses thereto attached known as the Hart Lots the same that the said Kello purchased at public auction, W'm.W. Briggs acting as commissioner, one slave named Brown, one slave named Patsey & one slave named Silas, 2 horses, 1 buggy, 1 Wag =gon all his household and Kitchen furniture, his Interest now or which may hereafter ac =crue to him in right of his wife, to that proportion of Wm. Prince's Est. which was directed by Will of said Prince to be withheld for purposes therein mentioned. In Trust to secure Samuel Kello in a bond due Jany. 1st. 1859, [sic] for the sum of two thousand Dollars, it being the Amount for the purchase of the said Tavern Lot & lands &c. Houses &c. mentioned above. Now if the said Bolivar T. Henderson should pay to the said Samuel Kello on the first of January 1860 the sum of Seven Hundred $ & on the 1st. of Jany. 1861, Three Hundred Dollars, & on the 1st. of Jany. 1862, Three Hundred Dollars, & on the 1st. [page break] [p.] 512 of Jany. 1863, discharge the balance that may then be due; Now if the said Bolivar T. Henderson should fail to make the respective payment at the time mentioned, upon the second default in the said payments the said trustee shall when directed so to do by the said Kello or his admr. set up & sell for cash after 10 days notice so much of said property as will discharge the proportion then agreed to be paid as above mentioned & at any time after the 1st. of January 1863, If he should then fail to pay when demanded, any balance that may then be due; the said trustee shall set up & sell the remaing portion (if any previously Sold) of the above ment =ioned property & pay to the said Kello what may then be due on the above mentioned bond & all costs & the bal: pay to the said Henderson. Present, Robert M. Doles, Benjamin E. Worrell, & Elliott L. Story, Justices [...] [p.] 541 [...] On the motion of Bolivar T. Henderson grantor & Saml. Kello, the beneficiary in a deed of Trust executed by the said Bolivar T. Hen- derson to Andrew J. Kello trustee for the benefit of Saml. Kello,- the trustee, the said Andrew J. Kello having died, John Kello is appointed trustee in his place. [...] Additional information: B.T. HENDERSON was declared Insolvent, 16 Jul 1860. (Southampton Co. WB17:195) His widow Rosa J. HENDERSON was granted administration on his estate, 20 Apr 1863. (Southampton Co. Court Minute Book 1861-70:99) Apparently this tract was returned to Samuel KELLO - he, wife Mary A.R., & son John G. KELLO sold it to Josephine Frances (DARDEN; Mrs. Henry S.) HOWARD, 9 Nov 1869.
