BRIGGS to John Julius KINDRED, deed of bargain & sale, Jerusalem, 20 Nov 1863 Account, 1 Dec 1863 (18 Jan 1864) This deed made this twentieth day of November in the year one thousand eight hundred and Sixty three between between William W. Briggs (grantor) of the first part and John J. Kindred (grantee) of the other part, Witnesseth; that whereas Bolivar T. Henderson in his lifetime did by deed of Trust which was recorded in the Clerk's Office of Southampton County Court on the eighteenth day of October A.D. 1859, or about that day, grant and convey to the Said Briggs a certain lot in the Village of Jerusalem in Said Southampton County, together with all the houses or tenements of every kind whatever Situated thereon, which lot is supposed to contain three acres, more or less, bounded by the lands of Samuel Kello and those belonging to the estates of F.J. Mahone and John Barham and which is more accurately described in a deed of bargain and sale from the said Jno. J. Kindred to the said B.T. Henderson admitted to record in the said Clerk's Office on the same day with the deed of trust first above alluded to, in which said deed of bargain and sale, the lot now by this Deed intended to be conveyed is exactly described - And whereas the said B.T. Henderson since the execution of the said deed of trust has departed this life. And a decree has been granted by the County Court of the said County the Style of which Suit is Kindred Plaintiff v' Rosa Henderson, Ellen Henderson and Anna Henderson, Defendants, authorizing the said Briggs, Trustee in the said Deed of Trust, to make sale of the said real estate in accordance with the provisions of the Said deed of Trust _ which said decree was granted at the May Term of the said County Court A.D. 1863. And whereas the said Briggs having duly advertised the same, did, on July County Court day A.D. 1863 Sell the said real estate at Public auction and the said Kindred became the Purchaser for the su of Five hundred dollars _ Now this Deed Witnesseth, that for and in consideration of the premises and the said Sum of five hundred dollars by the said Kindred to the said Briggs, the receipt of which is hereby acknowledged, the said William W. Briggs Trustee as aforesaid, doth hereby grant and convey to the said Jno.J. Kindred all of the real estate in the Proceedings and Said Deed of Trust Mentioned, with Such warranty of title &c. as is vested in him as said Trustee or Commissioner. Parker Commissioner Southampton County In the Clerks Office the 3rd. day of December 1863. This account of William W. Briggs' transactions as trustee in two deeds of Trust from Bolivar T. Henderson for the benefit of John J. Kindred was returned and filed for exceptions And at a Court held for the said County on the 18th. day of January 1864 the said account having lain one month and upwards in the Clerks Office and there being no exception thereto was examined, Confirmed and ordered to be recorded. HENDERSON was declared Insolvent, 16 Jul 1860. (Southampton Co. WB17:195) His widow Rosa J. HENDERSON was granted administration on his estate, 20 Apr 1863. KINDRED's chancery suit against her (Case 1863-009) was heard 18 May 1863. (Southampton Co. Court Minute Book 1861-70:99, 146) John J. KINDRED conveyed real & personal property to David H. KINDRED, in a deed of trust, for the benefit of Benjamin B. KINDRED, 1 May 1868.
