CLAYTON Deed of Trust [margin note] Ex.d This Deed made this 27.th day of July in the year one thousand eight hundred and seventy seven between Mary A. JORDAN of the one part, and Murdock M. CLAYTON, Trustee, of the other part, witnesseth, that the said Mary A. JORDAN doth grant unto the said Murdock M. CLAYTON, Trustee, the following property, to wit: one certain tract or parcel of land, containing one thousand and fourteen acres, more or less, lying and being in the Berlin and Ivor Magisterial District, and bounded by the lands of D.r S.P. KELLO, Benjamin BRISTER; James F. BOYKIN and others. In Trust, to secure the payment of the sum of nine hundred and fifty nine Dollars and twenty six cents, ($959.26) due by bond of this date and payable twelve months after date, which amount cancels all former deeds and contracts between the said Mary A. JORDAN and Richard W. CLAYTON, and due to Richard W. CLAYTON. In the eevent that default shall be made in the payment of the above mentioned bond, then the Trustees or either of them, on being required to do so by Richard W. CLAYTON, M.M. CLAYTON, Trustee, aforesaid, their successors or assigns, shall sell the property hereby conveyed. And it is covenanted and agreed between the parties aforesaid, that in case of a sale, the same shall be made after first advertising the time, place and terms thereof, for twenty days at the Court House door and 5 other public places, and upon the following terms, to wit: for cash as to so much of the proceeds as may be necessary to defray the expenses of executing this trust, the fees for drawing and recording this deed, if then unpaid, and to discharge the the [sic] amount of money then payable upon the said bond and if there be any residue of said purchase money, the same shall be made payable at such time and secured in such manner as the said Mary A. JORDAN her executors, administrators or assigns shall prescribe and direct, or in case of failure to give such direction, at such time and in such manner as the said Trustee, or either of them, shall think fit. The said Mary A. JORDAN covenants to pay all taxes, assessments, dues and charges upon the property hereby conveyed, so long as she or her heirs shall hold the same.
