NICHOLSON Deed of Trust [margin note] Exm.d Know all men by htese presents, that I, W.W. COLE of the County of Southampton, Virginia, in consideration of the sum of two hundred and fifty dollars, advanced me by D.r C.W. NICHOLSON, as shown by due bills, do sell and convey unto him, the following property, to wit: my entire crop of every description of cotton, corn, fodder, peas, peanuts, made in 1877. To Have and Hold to him, the grantee, and his heirs or assigns forever. I warrant this property free of all encumberance, and fully defend the right. It is, agreed, however, that if I, the grantor, or my representatives, pay unto D.r C.W. NICHOLSON or his representatives, the sum above named, on or before the 1.st day of March 1878, in redemption for this property, (and until such payment, shall not waste, destroy, injure, sell or remove the same, and in case of injury or death from any cause, of any cattle, horses, or hogs, thus conveyed, hold myself, heirs and assigns responsible for the full value thereof, waiving all Homestead exemptions) then these presents, and everything herein contained, shall cease and be void; otherwise, remain in force and effect. On default in the foregoing conditions, the grantee or his representatives, may sell the above property at auction, at any time, after ten days notice to the grantor, retaining the sum of money secured above, and all cost and charges of the sale, rendering the surlus, if any, to the grantor or his representatives. It is agreed also, that until default of these conditions, the grantor may retain possession of the property, and that the grantee or his representatives, may purchase at any sale made as aforesaid.
