All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Edward John BEATON (2/6/1813-1879), will dated 10 Nov 1878, recorded 19 Jul 1880 I, Edwin Beaton of the County of Southampton, and State of Virginia, being of Sound mind and memory, but Considering the Uncertainty of my Earthly existence, do make and declare this my last will and testament in manner and form following, that is to say; First; That my Executors hereinafter named shall provide for my body a decent burial Suitable to the wishes of my family and friends, and pay all my funeral expenses together with my just debts, howsoever, and to whomsoever owing out of the monies that may first Come into their hands as a part or parcel of my Estate. Second; I give to my wife Sophia A. Beaton, two beds and furniture, (first choice,) six chairs, (first choice) One horse, or Mule, first choice, one Cow and Calf, (first choice) & One hundred dollars in money. I also desire my wife Sophia A. Beaton to have during her life, One third the real Estate I may die Seized & possessed with, and to be laid off by Commissioners to be appointed by the Court of Southampton County, Virginia. Third; The balance my property both real and personal including my real Estate, at the death of my wife Sophia A. Beaton, I desire to be equally divided among all my Grand children, Viz; S. L. Beaton, Jules(?) S. Beaton, Jennie Estella Beaton, Annie Maria Beaton, Blanche Antoinette Beaton, Jennie Carr Beaton, children of my son Wm. M. Beaton and Antoinette M. Beaton, George N. Beaton, child of my son George E. Beaton, and Virginia O. Beaton, John Watford Beaton, child of my son John W. Beaton, and Rhetta Beaton, Lettie(?) A. Beaton, Walter Otis Beaton, children of my son John W. Beaton, and Sallie Beaton, Mattie B. E. Joyner, child of Wm. A. Joyner, and my Daughter his wife, now deceased, Mattie A. Joyner, and Nannie Pauline Beaton and Beale(?) Beaton Beaton, children of my son Edgar B. Beaton and Mattie E. Beaton, to have, they and their heirs forever_ In this my last will and Testament I make no mention of my Daughter Mattie E. Pugh, and her children, wife of Andrew Pugh, as I have a Life Insurance Policy for her benefit, Neither have I made mention of my Daughter Laura Beaton as I also have a Life Insurance Policy for her benefit._ And here I will state that it is my especial(sic) desire that One Thousand Dollars be taken by my Executors out of Insurance Policy for benefit of my Daughter Laura Beaton, and be applied towards the payment of a Deed Trust of about Said amount on what is Commonly known as the Liles(*) Tract Land. I wish this done so as to release said tract land of any encumbrance so that my wife Sophia A. Beaton, the Mother of said Laura Beaton can hold her thirds of said Tract land during her natural life_ I also give and bequeath to my Servant Girl Jennie Beaton (Colored) the sum of ten dollars and to my Servant Girl Caroline Beaton (Colored) I give the Sum of six dollars. And I hereby Constitute and appoint my sons Wm. M. Beaton and George E. Beaton, my Executors to all intents and purposes, to Execute this my last will and Testament, and that they be permitted to qualify without giving Surety as required by law. Lewis Walter Boone, At a Court held for the County of Southampton, on the 19th day of July 1880, This last will & Testament of Edward Beaton decd. was proved by the Oaths of C. C. Lewis and Walter Boone, the Subscribing witnesses thereto and Ordered to be recorded. And on the motion of Wm. M. Beaton & George E. Beaton, the Executors therein named, who made Oath according to law, and entered into and acknowledged a bond in the penalty of Fifteen Hundred Dollars, (but without Security, the will directing that none Should be required, and the Court requiring none,) Conditioned as the law directs, which bond is Ordered to be recorded. Certificate is granted the said Wm. M. Beaton and George E. Beaton, for Obtaining a probat of the said will in due form. Teste, L. R.
