All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Benjamin BEALE- will- dated 11 Apr 1808, recorded 16 Nov 1829 inventory & appraisement- taken 5 Dec 1829, returned 20 Sep 1830 estate account current & settlement- ordered Sep 1830, returned 16 Jan 1832 [margin note] Benj.a Beale's Will In the name of God Amen I, Benjamin Beale of Southampton County State of Virginia being of Sound Sense and memory, and Calling to mind the uncertainty of the human body do make constitute and ordain this my last Will and Testament in the following form. ~ First I desire that my lawful debts and funeral charges be paid out of my Estate the residue and remainder of my Estate, I lend to my beloved Wife Winefred Beale during her natural life or as long as She lives Single And at her death or marriage I give my land and plantation to my Son Matthew Beale and his heirs with this reserve, that my daughters [blank] and Sally Beale [blank] have a house and liberty to live on the [blank] and gound. as much as the Waters[?] with half of my orchard during their Single lives And then the whole of my land to my Son Matthew Beale and his heirs forever. All the remainder of my Estate I leave to be Equally divided between my Son Matthew Beale Winney Beale Mary Beale and Sally Beale my three daughters And Lastly. I do. This last Will and Testament of of Benjamin Beale dec.d was proved by the oath of John Fowler and Jordan Edwards, two of the Witnesses thereto and Ordered to be recorded, Winifred Beale the Executrix therein named having refused to take on himself the burthen of the Execution thereof And Kinchen Edwards. the Executor therein named being dead On the motion of Jordan Edwards who made oath and together with Simon Murfee and Benjamin Griffin his Securities entered into and acknowledged a Bond in the penalty of Six hundred dollars conditioned as the Law directs Certificate is granted the Said Jordan Edwards for obtaining letters of administration on the Said Benjamin Beale's Estate with his Will annexed in due form. Also the Sum of Nine dollars and Seventy four cents of Interest to be divided in the following manner Viz, to the Widow One third part of the personal Estate Say $18.86. to Matthew one fourth part of the remainder of the personal Estate Say $9.43¼. and three fourths of the balance of the real estate Say $22.80¾ cts. Making for amount $32.24 cts to Harrison Mountford in right of his wife one fourth of the personal Estate Say $9.43¼ to Sally one fourth of the personal Estate Say $9.43¼ and to Randall Fowler in right of his wife Winifred one fourth of the personal estate make $9.43¼ and one fourth part of the balance of the real Estate $7.60½ making in all the Sum of $17.03½ cts all which is respectfully Submitted to the Court.
