I give unto my son James C. Brister the farm on which I live together with my still, apple mill, Casks and all fixtures connected therewith to him and his heirs forever. 2nd. I give unto my son Benjamin B. Brister my smaller tract of land known as the "Bowers" tract, bounded on the west from my home tract by a line running N & S through my plum orchard to him and his heirs forever_ 3rd. After paying all debts and burial Expenses, I give unto my daughters :viz: Martha J. the wife of John T. Owney, Victoria W. the wife of Ezra T. Gay, and Juniata F. the wife of Aquilla Raiford, after selling to the highest bidder, and the proceeds equally divided to them and their heirs forever. In testimony whereof, I hereto affix my seal and sign this instrument as as my said will and testament this 18th dat of July in the Year of our Lord one thousand Eight hundred and Eighty two. Upon motion to admit to probat a certain writing dated July 18. 1882, as the last will and testament of James Brister decd_. This day Came as well the adult parties by their attorneys as the infant defendants by J.B. Prince their Guardian ad litem, and thereupon Came a Jury towit: J.S. Cook, R.H. Rawlings, R.S. Fagan, F.F. Ferguson, E.W. Beale, Geo E. Hill, W.H. Bradshaw, Edwin Bradshaw, Henry Babb, Scrap Joyner, Aurelius Edwards and Geo E. Vaughan, who being elected, tried and sworn the truth to speak upon the issue Joined in this case, towit: whether the writing bearing date July 18, 1882 purporting to be the last will and testament of James Brister decd, be the true last will and testament of said James Brister decd_ And the said Jury having heard the evidence by consent of parties and by assent of the Court were adjourned till tomorrow morning at nine o'clock A.M. Prince their Gdn ad litem and thereupon the Jury sworn to try the issue Joined in this Cause appeared in Court according to their adjournment and having fully heard the evidence upon their oath do say "We the Jury find this paper to be the last will and testament of James Brister decd_" Therefore is it considered by the court that the writing dated July 18. 1882 purporting to be the last will and testament of James Brister decd true be recorded as his last will and testa- ment, and that the Costs of this controversy be paid out of the Estate of said James Bristow decd, including $50, to the attorny for plaintiffs and defendants each.
