BARRETT (1765-1830), will dated 4 Nov 1830, recorded 15 Nov 1830 In the name of God Amen I Catharine Barrett of Southampton County Virginia, knowing the mortality of man and being in health and of sound mind and memory do make and ordain this my last Will and Testament in manner and form following to wit: First My Will and desire is that all my just debts should be paid. Secondly My Will and desire is that at my death all my Black people Should be free and named as follows: Dred, Denis, Peter, Miles, Jenny and young Dread with all their increase if any. Thirdly I give to my son John Barrett the whole of my land and plantation I am possessed of to wit the Land whereon I now live together with the tract of Land adjoining the Same that Benjamin Barrett bought of Jesse Barrett, Upon this proviso that he the Said John Barrett will or shall pay to my estate in two years after my death one thousand dollars the Said land to be possessed by him the Said John Barrett and his heirs forever. I give to my grandson Benjamin James Barrett Son of John Barrett half dozens black windsor chairs. also. I give to my grandson Davis Barrett Seven Silver tea spoons also I give to my grandson Benjamin T. Barrett Seven Silver tea spoons. Also I give to my daughter Lydia Bryant two dollars to her and her heirs forever. NB(?) My will & desire is that after my death all my estate not heretofore disposed of together with all my Bonds or accounts, I leave in my possession against the heirs of my estate or any other person Should be divided as follows: Item. First one Sixth part of my estate to my grandson Simmons Barnes Son of Bennett Barnes decd. and Should Said Simmons Barnes die without lawful issue that Sixth part to be divided as follows: one third to the heirs of my Son James Barrett, one third to the heirs of my daughter Lydia Bryant and one third to the heirs of my son John Barrett. Item Second: One sixth part of my estate to the Grand children of my son Giles Barrett and should one of the said Grand children of the said Giles Barrett die without Lawful issue the surviving heir or heirs take that part of the decd. heir or heirs and in case all of the said Grandchildren of said Giles Barrett die without lawful issue that sixth part to be divided as follows: one third to the heirs of James Barrett, one third to the heirs of Lydia Bryant, and one third to the heirs of my son John Barrett. Item Third: One sixth part of my estate to my daughter Nancy Darden and her husband during their natural lives and at their death if said daughter Nancy leaves no lawful issue that sixth part to be divided as follows. One third of said share to the heirs of my son James Barrett, one third to the heirs of my daughter Lydia Bryant, one third to the heirs of my son John Barrett. Item Fourth: One sixth of my estate to the heirs of my daughter Lydia Bryant and should one of those heirs die without lawful issue the surviving heir or heirs take that part of the decd. heir or heirs. Item Fifth: one sixth part of my estate to the heirs of my son John Barrett and should one of the heirs of said John Barrett die without lawful issue the surviving heir or heirs take that part of the decd. heir or heirs. Item Sixth: One Sixth part of my estate to the heirs of my Son James Barrett to wit Davis Barrett and Benjamin T. Barrett and should either of those two just named heirs die without lawful issue that the surviving heir of said James Barrett shall possess the Legacy of decd. heir and in case both of the said heirs of James Barrett decd. die without lawful issue their sixth part together with any all and every part the said heirs of James Barrett decd. shall or may be entitled to by the death of any of the before mentioned heirs of my estate shall be divided as follows: One half to the heirs of my daughter Lydia Bryant and the other half the heirs of my son John Barrett. Lastly I nominate and appoint my Son, John Barrett whole and Sole executor to this my last Will and Testament revoking all other wills by me heretofore made. In Witness whereof I have hereunto set my hand and affixed my seal this 4th day of November, one thousand eight hundred and thirty. Griffin At a court held for the County of Southampton the 15th day of November 1830 This last will and Testament of of (dupe) Catharine Barrett decd. was proved by the oath of Bennett Barrett, John H. Sandford and Jonathan T. Griffin the witnesses thereto and Ordered to be recorded. And on the motion of John Barrett the Executor therein named who made oath and together with Henry Kindred and Alexander Myrick his Securities entered into and acknowledged a Bond in the penalty of Six Thousand Dollars Conditioned as the Law directs Certificate is granted the said John Barrett for obtaining a probat of the said Will in due form Teste James Rochelle C.C.
