SOUTHAMPTON COUNTY, VA - WILLS AND ESTATES - Jacob Barnes, 15 Sep 1790 --------------¤¤¤¤¤¤-------------- IN THE NAME OF GOD AMEN, I Jacob Barnes of Southampton County, State of Virginia, being sick and weak in body but of sound memory & knowing it is appointed for all men to die, do make & ordain this my last will & testament. Principally & first of all, I recommend my soul into the hands of almighty God, and my body to the ground to be buried in a christian like manner. And as touching such worldy estate which it hath pleas'd (God) to bless me with in this life, I give in the following manner & form: Item: I give & bequeath to my son Benjamin Barnes one tract or parcel of land lying on the south side of the Cypress Swamp begining at a Maple in the north fork of the deep branch, thence along a line of mark'd trees to the second branch, thence along the said second branch to James Barnes line, thence along the said James Barnes's line to three black gums & then along the meanders of the Cypress Swamp to the mouth of the deep branch and up the said branch to the first station, to him & to his heirs and assigns forever. Item: I give & bequeath to my son Jacob one tract or parcel of land begining of a oak, a corner tree, in John Whitehead's line then along a line of mark'd trees to the ___ng of the second branch to James Barnes's line then along James Barnes line to a black gum in the great branch, then up the said branch to the cypress road then up the said road to Nathan Barnes's line then along the said Barnes's line to John Whiteheads line then along the said Whiteheads line to the begining to hold, to him & to his heirs and assigns forever. Item: I lend to my daughter Anne Barnes & Lela Vick the use of the room of my dewelling house for and during the term they shall remain unmarried & no longer, provided they do not dispose of their right to any other person. Item: I lend to my loving wife (Elizabeth) Barnes the use of the plantation whereon I now live with the lands belonging thereto not before dispos'd of for & during her life as widow and after her marriage or decease, I give & bequeath the said plantation & lands to my sons Josiah Barnes & Thomas Barnes to hold to my said sons & to their heirs and assigns forever. Item: I give and bequeath to my sons Joshua Barnes & William Barnes, to be equally divided between them, one tract or parcel of land lying in Pitt County, North Carolina near Little Contenty Creek, to hold to my said sons & to their heirs & assigns forever. Item: I give and bequeath to my son James Barnes one tract or parcel of land lying on the Hurrican branch in Edgecomb County, North Carolina, to hold to my said son & to his heirs & assigns forever. Item: I lend to my loving wife Elizabeth Barnes all the remainder of my estate of all kinds for and during her life a widow & in case my said wife marry, it is my will & desire that the whole of my personal estate shold (should) be equally divided between my said wife and all my children, or in case of the death of my said wife between all my children provided that if any of my children should have had any part of my personal estate before that time that the same be deducted out of their part. Item: I do appoint my loving wife Elizabeth Barnes & son Josiah Barnes to execute this my Last Will & Testament revoking all other Wills by me heretofore made.
