Item 1st After my death I desire that all my just debts and funeral expenses be paid out of my estate by my executor hereinafter named. Item 2nd I want my Executor as soon as he think best to sell my two negros Amos and Sukey and all other property I leave not disposed of except my land that I want sold about the fall or winter after my death. Item 3rd I wish my Executor to purchase two tom stones for myself and wife and put them up on our graves also to have half an acre of land around the grave yard reserved for my family burying ground and not sold at all. Item 4th. I give to my son Benjamin C Britt my silver watch and six hundred dollars in money or good lands to him and his heirs forever. Item 5th I give to my Daughter Mary A Britt one good bed and furniture and six hundred dollars to her and heir heirs forever. Item 6th I give to my Daughter Cornelia E Britt one good bed and furniture and six hundred dollars to her and her heirs forever. Item 7th I give and bequeath to my son James D Britt one thousand dollars to him and his heirs forever and I wish him to be sent to a good school by my executor is to pay all reasonable expenses of Board, Tuition, Clothes fe out of his share of my estate. I also want my son Benjamin C Britt to be sent to a good school one year and his expenses to be paid out of his part of my estate for Board, clothes, tuition & fe. Item 8th I give and bequeath to my son Mills H Britt, twelve hundred dollars to him and his heirs forever and I wish my Executor is to pay all of his expenses of tuition, Board clothes & fe and of his portion of his estate and if he should die before he arrives to the age of twenty one years in that case I wish the balance of his portion equally divided between my two Daughters Mary A Britt and Cornelia E Britt witness he should leave a lawful child or children then twenty one year old when he dies. Item 9th My will is that if any thing is left of my estate after paying off all the beformentioned Legacys of my will then I want that part equally Divided between my five children, Mary A Britt, Cornelia E Britt, Benjamin C Britt, James D Britt and Mills H Britt to them and their heirs forever. Item 10th My will is this if either of my beforenamed children should die before they arrive to the age of Twenty one years that their portion shall be equally divided as I have stated in Item 8. But if either of the other should marry and died leaving a lawful child or children before they are twenty one years old then their portion is to go to their children but if they leave no lawful child it is to go to the survivors as stated in the first of Item. Item 11th and lastly, I hereby nominate and appoint my friend James J Darden Exeuctor of this my last will and testament hereby revoking and annulling all other or former wills or testaments by me theretofore made. The last Will and Testament of Wm T Britt decd was proved by the oaths of Benjamin J Barrett and George H Darden, the subscribing witnesses thereto and was ordered to be recorded. And on the motion of James J Darden the executor there in named who made oath and together with Richard J Darden and Davis Barrett his securities (who justified on oath as to the sufficiency) entered into and acknowledged a bond in the penalty of Ten thousand Dollars conditioned according to Law Certified is granted him fro obtaining a probate of the said will in due form.
