First, that my executor herein after named, shall provide for my body a decent burial, suitable to the wishes of my relations and friends and pay all funeral expenses, together with my just debts himsoever and to whomsoever owing out of the first moneys that may come unto his hands as a part or parcel of my estate. 2d. I loan to my beloved wife Margaret, for and during the term of her natural life the trace of land whereon I now reside, containing about two hundred and seventeen (217) acres, also my horse, stock of cattle, hogs, provisions of all kinds, carts, wheels, ploughs, tools, household and kitchen furniture, in fact, every thing that may be on the farm at my death to be held together and managed by my son James E Britt for the support of my said beloved giving him everything that he may make over and above her support during her life on such said property. Item 3d. I give and bequeath to my son James E Britt one tract of land lying in the County of Hertford State of North Carolina, adjoining the lands of Joshua Furferson and others containing one hundred and twenty acres, more or less to him and his heirs forever; it is my will that said James E Britt shall pay over to my son William D Britt the sum of two hundred & fifty dollars to make him equal in said tract of land. Item 4th. I give and bequeath to my oldest daughter Louisa Jackson the sum of one dollar to her and her heirs forever. Item 5th It is my will and desire that the tract of land all the other property that I have loaned to my wife and mentioned in, Item 2d, after her death shall be sold and equally divided between my following named children, viz: Henry M Britt, [page break] Jno D Britt, Mills C Britt and Edney F Whitney to share and share alike to them and each of them their executors, administrators and assigns absolutely and forever. And Lastly, I do hereby constitute and appoint my son Henry M Britt my lawful executor to all intents and purposes to execute this my last will and testament according to the true intent and meaning of the same and every part and clause thereof, hereby revoking and declaring utterly void all other wills and testaments by me heretofore made.. In witness whereof I the said Jonathan T Britt do hereunto set my hand and seal this 20th day of September A D 1865. Signed, Sealed, published and declared by the said Jonathan T Britt to be his last Jonathan T Britt [seal] and testament in the presence of us who at this request and in his presence do subscribe our names as witnesses thereto Saml D Winborne Jeremiah O Johnson At a Court held for the County of Southampton on the 16th day of ____ 1866. This last will and testament of Jonathan T Britt decd was published by the oaths of Saml D Winborne & Jeremiah O Johnson the subscribing witnesses thereto and ordered to be recorded.
