As to my property I dispose of the same as follows: First that my certain tract of land lying, situate and being in Southampton County, Virginia known and the Jonathan Britt tract of land, if not sold in my life time, shall be sold as soon after my death as practicable and the proceeds of sale shall be equally divided among my children as follows: R E Britt, F T Britt, I W Britt, Julia M Parker, Nina C Britt, Joseph C Brett, Mark D Britt and first from the proceeds and before any distribution is made of the funds I desire that Ten Dollars be paid out of the funds to H A Britt, my oldest son, who is not give a share in this land for the reason that he has heretofore received from my estate his full share. Second: I give and devise to my beloved wife for and during her life time that certain piece, parcel or tract of and known as the Vincent tract of land, lying, situate, and being in Southampton County, Virginia, also to my beloved wife Rosa A Britt, I give and devise for and during her life that a certain piece, parcel or tract of land lying, situate and being in Hertford County, North Carolina, known as a part of the H M Britt tract of land, and a the death of my beloved wife, Rosa A Britt, I devise the remainder of the J M Britt tract of land to Nina C Britt and Joseph C Britt in fee simple, share and share alike, and at the death of my beloved wife, the said Rosa A Britt, I devise the remainder of the Vincent Tract above mentioned to my children as follows: To Mark D Britt, I devise in fee simple to him and his heirs forever, that portion of the said tract lying on the east side of the County road, containing about 35 acres and bounded on the south by the State line, east by the lands of W R Worrell, north by the lands of Mrs J G Holland, west by the County road, and the remainder of the Vincent tract I give and devise in fee simple to R E Britt, F T Britt, I W Britt, and Julia M Parker, share and share alike, to have an dispose of as they shall deem best. Third: I give, devise and bequeath unto my beloved wife, Rosa A Britt, all of my chattel which I shall died possessed wherever the same may be located to have an to use and dispose of as shall to her seem best. I nominate and appoint my beloved son Joseph C Britt as Executor of his my last will and testament and desire that he Court will permit him to qualify without security. I respectfully request and enjoin by beloved son Joseph C Britt not to charge my estate for his services as Executor other than the actual cost of executing this trust. Given under my hand and seal this 17th day of February 1916. Witness: T H Barrett Witness: R O Hill North Carolina, Herford County. In the Superior Court Before the Clerk. In the Matter of The Will of W C Britt, Deceased. The paper writing hereto attached and purporting to be the last will and testament of W C Britt deceased, is exhibited before the undersigned Clerk of the Superior Court of Hertford County, North Carolina, by Joseph C Britt, the Executor therein named, and thereupon [page break] the following proof thereof is taken b the oath and the examination of T H Barrett and R O Hill, the subscribing witnesses thereto, as follows: North Caroling, Hertford County. T H Barrett and R O Hill being duly sworn, depose, and say and each for himself deposes and says, that he is a subscribing witness to the said paper wiring now shown him, purporting to be the last will and testament of W C Britt, and that he saw him execute this writing as his last will and testament, and that affiant at tested it in the presence and at the request of W C Britt, deceased: and that at the time of the execution of said W C Britt, was in affiant’s opinion of sound mind and disposing memory. T H Barrett. R O Hill. Severally subscribed and sworn to me before this 25th day of June, 1918. D R McGlohon, Clerk Superior Court Hertford County. And thereupon it is considered and adjudged by the Court that he said paper writing and every part thereof is the last will and testament of W C Britt, deceased, and it is ordered that the same, with the foregoing examination and this certificate, be recorded and filed. This 25th day of June, 1918., D R McGlohon, Clerk of Superior Court of Hertford County. State of North Carolin Hertford County. I D R McGleohon, Clerk of the Superior Court in and for the above named County and State, do herby certify the forgoing three (3) sheets to be and contain a true and accurate copy of the Will of W C Britt, deceased, and the probate thereto, as the same appears of record. In testimony whereof, I hereunto set my hand and affix the seal of this Court. This the 28” day of August, 1918. The foregoing Will of W C Britt, deceased, was this day received and with certicates thereunto annexed, admitted to record.
