Item I give unto my son Anthony CALTHORPE and his heirs forever my land and plantation I bought of the nottoway Indians containing four hundred acres of land... [page break] [p.] 31 Item I give unto my son James Butts CALTHORPE and his heirs forever my land and plantation on Cosurigua[?] I bought of Benjamin CLIFTON being about three hundred & sixty five acres: Item I give unto my daughter Mary BAYLEY all that part of my estate I have given her in possession already: Item I give unto my daughter Frances JONES my negro woman Sarah her son Ben and my negro boy Harrissson: Item And for as much as my wife is now with child and should she be delivered of a son: I then give unto my said son my land and plantation in York county and Charles parish containing about two hundred and thirty acres to him and his heirs forever:. But in case the child my wife is now bigg with should be a daughter I then give the aforementioned land in york county to my son Edward CALTHORPE & his heirs forever: Item I give all the remainder of my estate of what nature soever to be equally divided amoungst my seven children (to wit) Sarah; Eliz.a; Martha; Anne; Edward; Anthony; and James Butts CALTHORPE and the child or children my wife is now bigg with And for somuch as my wife will take such part of my estate as the law shall give her my will and desire is that the slaves she shall take in her dower should be after her death equally divided amoungst my seven children above mentioned and child or children my wife is now bigg with:... lastly I doe appoint my sons in law John BAYLEY and Jesse JONES my executors of this my last will and testament hereby revoking all other wills heretofore made by me I[n] Witness whereof I have hereunto set my hand and seal this eighth day of november 1756: Charles CALTHORPE *LS* Signed Sealed & Published: in presence: J GRAY Richard COBB [page break] [p.] 32 At a Court held for the county of Southampton the 14 day of April 1763. This will was presented in court, proved by the oaths of Joseph GRAY and Richard COBB the witnesses thereto & ordered to be recorded & John BAYLEY and Jesse JONES the ex'ors therein named now in court refused to take the execution thereof & Sarah the widow of the testor also refused to take adm'on on the said decedents estate Whereupon on the motion of Edmund TYLER who made oath according to law certificate is as granted him for obtaining letters of administration on the estate of the said decedent with the will annexed giving Security whereupon &c.
