SOUTHAMPTON COUNTY, VA - WILLS AND ESTATES - John Council, 2 Jan 1785 --------------¤¤¤¤¤¤-------------- Will: John Council, Nottoway Parish, Southampton Co, VA IN THE NAME OF GOD AMEN I John Council of the Couonty of Southampton & Parish of Notoway being in perfect health & in sound sense & memory, thanks be to almighty God for the same, do make and ordain this my last will & testament in manner & form following. First, I commut my immortal soul into the hands of God who gave it in hopes of acceptance with Him through the merits of my dear Lord and saviour Jesus Christ and the poor? last remains of my body to the dust to be buried at the discretion of my Executors hereafter mentioned and as for the worldly goods it hath been pleased God to bless me with, I dispose of in the following manner: Item: I give and bequeath to my son Amos Council a parcel of land containing one hundred acres be the same more or less bounded as follows, to wit: beginning at a white oak a corner tree betwist me and John Worrell being a side line between myself, Giles Johnson & John Worrell so along a line of marked trees through the Little Pocason to Piney Ridge road up the said road to the mouth of Round Hill road up said road to the head of the gum branch from thence along a line of marked trees to William Mackey line to a corner tree a pine from thence along said line to Piney Ridge road thence down said road to the gum branch down said to the mouth of a small branch up said small branch to the head from thence to the corner of the before mentioned Pocason from thence down said Pocason to the corner tree the first station to him and his heirs forever. Item: I give and bequeath to my son Jesse Councill after the death of marriage of my daughter Lydda, Tabitha, Sarah, and Temperance, viz: (my meaning is that neither of my daughters should be disturbed in using possessing and enjoying my manner plantation during their maidenhood & he among them his equal part and after their maiden hood to him & his heirs forever and shoud (should) my son Jesse die without isue (issue) to be equally divided betwixt my daughters Lydda, Tabitha, Sarah & Temperance to them & their heirs forever. Item: I give and bequeath to my son John Council, provided he shoud have an heir lawfully begotten of his body, all my land lying on the north side of my son Amos's containing one hundred acres, be the same more or less, to him and his heirs forever & shoud he die without such heir to my daughter Lydda to her and her heirs forever. Item: I give and bequeath to my son John Council for the use of building him a house ten pounds to (be) raised out of my estate. Item: I give and bequeath to my son John Council for his education five pounds to be raised out of my estate. Item: I give and bequeath to my daughter Lydda Council one feather bed & furniture called the new bed and one desk to her and her heirs forever. Item: The remaining part of my estate I leave to be equally divided amongst my children: Amos, Jesse, Lyda, Tabitha, Sarah, Temperance and John, to them & their heirs forever. Item: I also do appoint my sons Amos & Jesse Council the whole & sole Executors of this my Last Will Testament disannulling all other Will or Wills, writings, claimes, or demands against this my Last Will & Testament. IN WITNESS whereunto I have hereunto set my hand & affixed my seal this second day of January one thousand seven hundred and eighty five. John Council (seale) Signed, sealed, published & declared in presence of us: David Barrows Giles Johnson Stephen Johnson At a Court held for the County of Southampton the 11th day of April 1793 This Will was presented in Court by the Executors therein named & proved by the oath of David Barrow, a witness thereto who also deposed that Giles and Stephen Johnson, the other witnesses, who are since dead, subscribed their names as witnesses to this said Will in presence of the Testator, whereupon the said Will is order (ordered) to be recorded, And At a Court held for the County of Southampton the 12th day of April 1793 Amos & Jesse Council, the Executors named in the said Will having first made oath as the law directs, a Certificate is granted them for obtaining a Probat thereof in due form giving security whereupon &c.
