All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Ann DRAKE (1680-1775), will dated 27 Jun 1775, proved 10 Aug 1775 In the name of God Amen I Ann Drake of Southampton County being weak of body but of sound and perfect mind and memory and calling to mind the uncertainty of this transitory life do think proper to make this my last will and testament and dispose of the effects wherewith God hath been pleased to bless me in manner and form following. Viz: Imprimis: I desire my just debts be first paid and discharged. Secondly I give devise and bequeath unto Ridley Drake, Cordial Drake the two eldest sons of Barnaby Drake Junior all my lands being the plantation whereon Timothy Drake and myself now live containing by estimation one hundred and forty five acres to them and their heirs and assigns forever. Thirdly I give devise and bequeath unto Ridley Drake on his attaining the age of twenty one years one feather bed and furniture, one cow and calf, one walnut oval table to him and to his heirs and assigns forever. Fourthly I give and bequeath unto Cordial Drake on his arriving to the age of twenty one years one feather bed and furniture, one cow and calf, one chest, one black trunk and one small gilded ditto to him and to his heirs forever. Fifthly I give and bequeath unto Burges Joyner one cow yearling to him and to his heirs forever. Sixthly I give and bequeath unto Baker Joyner one cow yearling to him and to his heirs forever. Seventhly I give and bequeath unto Eaton Joyner ine cow yearling to him and his heirs forever. Eighthly I give and bequeath unto Baldy Drake one black cow yearling to him and his heirs forever. Ninthly I give and bequeath unto Mary Drake wife of Barnaby Drake junior and to Tabitha Joyner my riding saddle and bridle. Tenthly I give and bequeath unto Barnaby Drake junior all the remainder of my cattle to him and his heirs and assigns forever. Eleventhly I desire that my sister Mary Drake should live in and possess the house and plantation whereon I now live and keep in her possession all the goods I have given to Ridley and Cordial Drakes that are not published unto the time for them to take it in their own possession, that the negro girl Pat be kept on the plantation and employed there at and by the direction of my executor hereafter named for the benefit of my estate. Twelvethly I give and bequeath unto Ridley Drake and Cordial Drake provided they live to the age of twenty one years all the remainder of my estate of nature or kind soever to be at that time equally divided between them but in case either of them should die before said time then I do give and bequeath the whole to the survivor and his heirs and assigns forever. Lastly I do hereby nominate ordain constitute and appoint Barnaby Drake junior my whole and sole executor to this my last will and testament hereby revoking disannulling and disallowing of all other wills legacies or bequests by me heretofore made acknowledging and declaring this and no other to be my last will and testament. In witness hereof I have hereunto set my hand and seal this twenty seventh day of June in the year of our Lord one thousand seven hundred and seventy five. Ann (her mark) Drake Witness: J Denson Mourning Joyner Jonas Joyner At a court held for the county of Southampton the 10th day of August 1775 this will was presented in court by Barnaby Drake the executor therein named and proved by the solemn affirmation of Jordan Denson and by the oath of Jonas Joiner two of the witnesses thereto and ordered to be recorded and on the motion of the said executor who made oath according to law certificate is granted him for obtaining a probat thereof in due form giving security, whereupon etca.
